I have met with Staff over several months on adjustments to the wording of this ordinance to make sure we
have the best possible outcome.
I disagree with the legal standing in which this ordinance was finalized. This ordinance will damage and legally affect
exisƟng approved PUD and Subdivisions. We install infrastructure based on the findings and decisions given by the city
and those approvals are relied upon. This ordinance will supersede prior approvals from the city in which we believe are
legal binding agreements with the City. I provided specific examples of lots which have Stormwater approvals. Once this
ordinance is passed those approvals would no longer be valid and thus those properƟes would be damaged. I believe
there are possibly many more similar PUD’s and Subdivsions in which the City has approved and required owners to
meet certain standards and this ordinance will no longer make those binding agreements valid. I urge the City Council to
adjust this ordinance to uphold their approvals. The community needs to be able to rely on these approvals or else the
foundaƟon in which all approvals are given will be severely quesƟoned in the future.
Dane Butler
541‐913‐3288
CA 24-3 Testimony Batch 3
