2 <br />WOBA has never seen in our review of the NPDES permit or received from the City where it specifically says the city <br />would be in violaƟon of their permit requirements if they don’t reverse there exisƟng process. The City’s exisƟng process <br />is that previous approved PUD’s and Subdivisions in which stormwater is specifically addressed can develop based on <br />their approval given by the City themselves. We don’t believe anywhere in the NPDES permit that DEQ requires the City <br />to not uphold their exisƟng legally binding approvals. <br />I wanted to make sure I followed up with you all aŌer last night. WOBA is not looking for exempƟons and was on board <br />with expiring of historical lots that don’t address stormwater in their approvals. We are not on the same legal page in <br />which our current PUD and Subdivision approvals are no longer valid when stormwater has been reviewed, inspected <br />and approved by the City. <br />We 100% believe the city has the ability to adhere to their own approvals and update this ordinance in a simple and <br />efficient way. <br />Thanks <br />Dane Butler <br />WOBA <br />CA 24-3 Testimony Batch 3
