analysis, and confirmed by staff, there are an adequate number of parking spaces to meet the <br />minimum parking requirements within the development site. <br />Land Use Management staff is concerned that should any of these lots be sold into separate <br />ownership, a non-compliant parking situation would be created. To prevent such a non-compliant <br />situation, the following condition of approval is imposed: <br />Prior to conveyance of the lots containing Buildings C and D into separate ownerships from <br />the lots containing Buildings A and B such that they no longer constitute one development <br />site per EC 9.0500, an off-site parking agreement pursuant to EC 9.6410(1) shall be <br />submitted to the City for review and approval. <br />Based on the above findings and requirements, this condition is satisfied. <br />i. EC 9.6415(1) and (2) Drive-through Design Standards and Landscaping <br />This condition is not applicable as no drive-throughs are proposed within this phase. <br />j. EC 9.6420(3) Parking Area Standards (except where noncompliance was <br />approved through the tentative PUD) <br />With the exception of the request adjustments proposed in the concurrent adjustment review <br />application (City file ARA 07-1), the proposal meets this code section. The findings and <br />requirements below from the adjustment review evaluation under EC 9.8030 are incorporated herein <br />as demonstration of compliance with this condition. This condition is satisfied. <br />k. EC 9.6730 Pedestrian Circulation On-Site (for residential buildings, and <br />commercial buildings less than 25,000 square feet) <br />1. EC 9.6780 Vision Clearance Area. <br />The final PUD plans are consistent with'these standards. <br />25. The following standards shall be reviewed for compliance at the time of building <br />permit submittal: <br />a. EC 9.2171(9) Fences <br />b. EC 9.2171(10) Outdoor Storage Areas <br />c. EC 9.2171(11) Outdoor Merchandise Display <br />d. EC 9.2171(12) Garbage Screening <br />e. EC 9.2751(13) Fences <br />f. EC 9.6725 Outdoor Lighting Standards <br />The conditions listed in a. through e. above are not applicable to this phase of development, as the <br />subject property is not commercially zoned. Compliance with f. will be reviewed at the time of <br />building permit. To the extent that the above condition requires, specific performance after final <br />approval, this condition will remain in effect and be included as part of the PUD performance <br />agreement for the project. <br />26. Final PUD plans shall show compliance with EC 9.2171(14) and EC 9.2173(9) Delivery <br />and Loading Facilities. Alternatively, delivery and loading shall occur from the public <br />Crescent Village Phase 3 (PDF 07-1 & ARA 07-1) June 2007 Page 8
