19. Sidewalk location and design details shall be reviewed and approved by Public Works <br />staff during the construction permitting process with the intent of maximizing setback <br />sidewalk use in residential areas. Sidewalks adjacent to developed properties, common <br />areas, and unbuildable areas shall be designed and constructed during the PEPI <br />process. Sidewalks along existing Crescent Avenue may be meandered to accommodate <br />berms and landscaping, but must be placed within the existing right-of-way. <br />Sidewalks for this phase of the development were constructed through an approved PEPI or will be <br />reviewed during the construction permitting process, consistent with this condition. <br />20. Stormwater drainage facilities within the development site shall be sized and <br />constructed in accordance with Chapter 7 of the Eugene Code. Detailed analysis and <br />design studies will be required during the PEPI review, the approved system capacity <br />and design shall be consistent with the analysis approved by Public Works staff. <br />Public stormwater facilities shall be located within public rights of way or public utility <br />easements. Public utility easements shall be a minimum of 14 feet wide. The final PUD <br />drawings shall clearly identify which facilities are private and public facilities. <br />Public Works staff notes that storm drainage facilities in the right-of-way were reviewed and <br />approved as part of the related PEPI permit, consistent with this condition. Private stormwater <br />facilities are shown on the utility plans included in the Final PUD plan set (Sheet C 3.0), which <br />illustrate that constructed wastewater improvements can be utilized. Public Works staff concur with <br />this submittal on a conceptual basis and note that stormwater facilities will be evaluated for <br />compliance with the applicable standards during the building permit phase. <br />21. The applicant shall use the City of Eugene's adopted Stormwater Quality BMP <br />Manual or Portland's Stormwater Manual to design and construct any proposed <br />green" stormwater facilities. Private maintenance responsibilities shall be included in <br />the revocable permit for any private "green" stormwater infrastructure located in the <br />public right-of-way and shall be identified in the CC&R's. The applicant shall be <br />responsible for providing a design for any public "green" stormwater features that is <br />compatible with street tree requirements. The Urban Forester shall review and <br />approve alternative tree species before the privately engineered public improvement <br />plans are approved. <br />Consistent with this condition, the applicant notes that the above mentioned design manuals will be <br />used for any proposed "green" stormwater facilities and that all private facilities will be on private <br />property. <br />22. The maximum front yard building setback along Crescent Avenue shall not exceed 25 <br />feet for the buildings on Blocks L, M, N, and P, and the two buildings on Block A and <br />on Block B along Crescent Avenue. The maximum front yard setback may be <br />exceeded if the area between the building and the front property line is landscaped or <br />paved for use by pedestrians, to be reviewed at the time of final PUD. The area must <br />contain at least the equivalent of one enhanced pedestrian amenity for every 200 <br />square feet of hard surface. <br />This condition is not applicable to this phase, as no buildings are proposed along Crescent Avenue. <br />Crescent Village Phase 3 (PDF 07-1 & ARA 07-1) June 2007 Page 6
