consistent with the analysis approved by Public Works staff. Public stormwater facilities <br />shall be located within public rights of way or public utility easements. Public utility <br />easements shall be a minimum of 14 feet wide. The final PUD drawings shall clearly identify <br />which facilities are private and public facilities. <br />Consistent with this condition, the modification includes conceptual utility plans to ensure <br />stormwater facilities are designed consistent with Chapter 7, and to identify which facilities are <br />private and which are public. <br />21. The applicant shall use the City of Eugene's adopted Stormwater Quality BMP Manual or <br />Portland's Stormwater Manual to design and construct any proposed "green" stormwater <br />facilities. Private maintenance responsibilities shall be included in the revocable permit for <br />any private "green" stormwater infrastructure located in the public right-of-way and shall <br />be identified in the CC&R's. The applicant shall be responsible for providing a design for any <br />public "green" stormwater features that is compatible with street tree requirements. The <br />Urban Forester shall review and approve alternative tree species before the privately <br />engineered public improvement plans are approved. <br />Consistent with this condition, the applicant has acknowledged and Public Works concurs that any <br />green" stormwater facilities will be required to meet the designated standards. <br />22. The maximum front yard building setback along Crescent Avenue shall not exceed 25 feet <br />for the buildings on Blocks L, M, N, and P, and the two buildings on Block A and on Block B <br />along Crescent Avenue. The maximum front yard setback may be exceeded if the area <br />between the building and the front property line is landscaped or paved for use by <br />pedestrians, to be reviewed at the time of final PUD. The area must contain at least the <br />equivalent of one enhanced pedestrian amenity for every 200 square feet of hard surface. <br />This condition is not applicable to this modification, as it does not include Block A, B, L, M, N or P. <br />23. The building located on Block P shall not exceed 35 feet in height within 50 feet of the <br />adjacent residentially zoned property, and shall be setback a minimum of 30 feet from the <br />adjacent residentially zoned property, pursuant to EC 9.2171(3) and (7). <br />This condition is not applicable to this modification, as it does not include Block P. <br />24. The final PUD plans shall show compliance with the following standards: (An approved <br />adjustment shall constitute compliance.) <br />a. EC 9.2171(5)(d) and EC 9.2173(3)(a) and (b) for the buildings on Blocks L, M, N and P. <br />b. EC 9.2173(8) Service and Loading Areas <br />c.
