Per EC 7.280, development proposals that involve the creation of streets are required to create <br />attractive and healthy neighborhood environments that include street trees. An approved street tree <br />plan and a financial guarantee that the street trees will be planted, in accordance with requirements in <br />Eugene Code 7.280, will be required by the Urban Forester during the street dedication process. <br />In regards to EC 9.605(4), with the exception of Suzanne Way, Tennyson Avenue between Melville <br />and Suzanne Way and Shadow View Drive between Crescent Drive and the private park blocks, the <br />applicant is proposing setback sidewalks as required by the local street design standards on the <br />proposed interior streets. A curbside walk on the north side of Tennyson Avenue between Melville and <br />Suzanne Way is allowable in infill situations to reduce the right of way widths adjacent to existing <br />development and on commercial streets. The applicant is also requesting an adjustment to meander the <br />sidewalk at driveway aprons along the east side of Lord Byron Place for constructability. Public Works <br />staff concurs that this may be necessary to allow vehicles sufficient clearance to enter parking levels <br />without bottoming-out. Public Works staff shall review and approve specific design details during <br />construction permitting with the intent of maximizing setback sidewalk use. <br />The applicant is proposing a meandering sidewalk along existing Crescent Avenue right of way. <br />However, there is insufficient right-of-way to construct the public sidewalk as proposed. Therefore, the <br />public sidewalk shall be placed within the existing right-of-way in a setback alignment. <br />The applicant is also proposing to highlight the pedestrian ways with brick or other contrasting color. <br />Final design details will be completed during the privately engineered public improvement process, but <br />Public Works prefers the use of stamped or colored concrete, which has less maintenance liability. <br />Sidewalks are typically constructed with building permits, but sidewalks adjacent to developed <br />properties, common areas, and unbuildable areas, shall be designed and constructed during the PEPI <br />process. <br />In regards to EC 9.6505(5), a pedestrian path is proposed from Lord Byron Place to the existing path to <br />the east. This criterion is evaluated under criterion EC 9.6835; those findings are incorporated here by <br />reference. Design and construction of the pedestrian path shall be included with the privately <br />engineered public improvements for the North Townhouses Phase. <br />In regards to EC 9.65 10, the applicant is proposing to privately engineer and construct stormwater <br />drainage facilities within the development site and discharge stormwater runoff into the existing public <br />stormwater facilities along the east site boundary and Crescent Avenue. As indicated in the 2002 <br />Stormwater Basin Master Plan, the facilities are sufficiently sized to accommodate the future <br />developed runoff from this site. Public Works staff concludes this information is adequate to <br />demonstrate compliance with this criterion. Stormwater drainage facilities within the development site <br />shall be sized and constructed in accordance with Chapters 6 and 7 of the Eugene Code. Detailed <br />analysis and design studies will be required during the PEPI review, the approved system capacity and <br />design shall be consistent with the analysis approved by PW staff. <br />The applicant indicates that stormwater facilities will be provided and dedicated to the public, but the <br />PUD drawings do not indicate which facilities will be private nor which will be public. With the <br />exception of private connections, private facilities will not be permitted within the public rights of <br />ways or public utilities. Public stormwater facilities shall be located within public rights of way and <br />public utility easements as necessary to ensure that public rights of way include public drainage <br />facilities to prevent flooding in the public streets and to serve the adjacent lot drainage needs.
