utility easements shall be a minimum of 14 feet wide. Approved final PUD drawings shall clearly <br />identify which facilities are private and public facilities. <br />The applicant also indicates that they intend to incorporate "green" storm systems in their design <br />proposal. Although these measures are not required, Public Works staff encourages "green" <br />stormwater quality designs. The applicant shall use the City of Eugene's adopted Stormwater Quality <br />BMP Manual or Portland's Stormwater Manual to design and construct any "green" stormwater <br />facilities. "Green" infrastructure are primarily private facilities and should not be located in the public <br />right of way, however, if during the review process the use of the right-of-way is approved as the best <br />location, a revocable permit will be required. Maintenance responsibilities shall be included in the <br />revocable permit and identified in the CC&R's. <br />The proposed storm drainage swales for street runoff are considered a "green" stormwater feature that <br />may be a public improvement. The designated location conflicts with the planter strip area and the <br />applicant shall be responsible for providing a design that is compatible with street tree requirements. <br />Incorporating swales that carry storm drainage from the streets can impact the life and stability of most <br />of the approved tree species. The Urban Forester shall review and approve alternative tree species <br />before the privately engineered public improvement plans are approved. Another conflict that needs to <br />be resolved is the design of the drainage openings in the curbs. The City's standard street maintenance <br />policy allows for the street sweepers to clean the gutter bar, but not the drainage openings. Properties <br />adjacent to the rights of way are responsible for maintenance of the sidewalks and planter strips. A <br />storm drainage maintenance agreement shall be reviewed and approved before privately engineered <br />public improvements are approved. <br />Private storm drainage connections to the public system shall be designed and constructed <br />perpendicular to the street. Connections similar to the two private basin connections along Crescent <br />Avenue shown on sheet C 1.6 of the plans will not be permitted. <br />Based on the above findings and conclusions, staff recommends the Hearings Official find that the <br />proposal complies with this criterion. <br />c) EC 9.6706 Development in Flood Plains through EC 9.6709 Special Flood Hazard <br />Areas - Standards. <br />The subject property is located in Zone X, outside the 500-year flood plain per Flood Insurance Rate <br />Maps (FIRM) for this area (41039C1 129F, 41039C1133F and 41039C1 135F effective date June 2, <br />1999). As such, FEMA regulations not apply to the proposed development. <br />d) EC 9.6710 Geological and Geotechnical Analysis. <br />The applicant submitted a Level One Geological and Geotechnical Analysis as required for a PUD <br />development site having slopes less than 5% that include dedication and construction of public <br />improvements. Public Works staff referral comments confirm the analysis complies with this criterion <br />and that a higher level of investigation is not required at this time. This criterion is satisfied. <br />e) EC 9.6730 Pedestrian Circulation On-Site. <br />As proposed, the development generally complies with this criterion as it relates to office and commercial <br />development. Pedestrian paths are shown between all building entrances and streets adjacent to the <br />Staff Report for Crescent Village PUD (PDT 04-1) April 19, 2004 Page 29 of 54
