Larry Smith, Videra Drive HOA <br />4 <br /> <br />In 2021 the proposed site was evaluated using the Oregon Rapid Wetland Assessment Protocol (ORWAP). <br />The applicant estimates an average depth of 2.01 feet and a maximum depth of 3.8 feet which is within the <br />range used in Table2. A more accurate estimate could be determined through direct measurements on the <br />property by the applicant as part of a comprehensive stormwater analysis and treatment plan. <br /> <br />Figure 5. Estimated Water Volume Retained by Typical Wetlands <br />The goals set by the City of Eugene regarding development of properties such as the subject here are <br />stated in the ICS Task Team Project Goals Statement (2008): <br />“Create and adopt land use code standards and processes that (a) Prevent residential infill that <br />would significantly threaten or diminish the stability, quality, positive character, livability or <br />natural resources of residential neighborhoods…” <br />Eugene city code also addresses the use of Goal 5 properties within the /WR overlay: <br />“9.4900 /WR Water Resources Conservation Overlay Zone - Purpose. The purpose of the /WR <br />Water Resources Conservation overlay zone is to provide conservation of significant riparian <br />areas, wetlands and other water-related wildlife habitat areas included on the city’s adopted Goal <br />5 inventory. In order to conserve these resources and the biological systems they contain and <br />support, the overlay zone not only conserves the physical resources but also protects the water <br />quality within the resource areas as a fundamental and essential requirement for continued <br />survival of these biological systems.” <br />The code makes some exceptions for “needed housing”, a classification being sought for this application. <br />The code also provides for some flexibility to be exercised by the Planning Director: <br />“9.0040 Land Use Code and Decision Interpretation. (1) The planning director is authorized to <br />interpret this land use code and decisions issued pursuant to this land use code. <br />Page 54 of 87
