Prior to final PUD and plat approval, the applicant shall submit Private Joint Use Access <br />and Utility Easement and Maintenance Agreement (JAM). The JAM will include a <br />description defining the area of the private street and will also identify permitted <br />improvements, construction expectations, rights of usage and maintenance <br />responsibilities for the facilities in the street. The JAM will be recorded concurrent with <br />and cross-referenced on the final plat. <br /> <br />6. Provisions for a public emergency access easement within the private street may be <br />included in the proposed JAM which creates the private street, or alternatively may be <br />dedicated as a Public Emergency Access Easement on a standard City form. <br /> <br />Based on the available information and proposed conditions, the standards at EC 9.6800 <br />through EC 9.6875 are met to the extent they are applicable. <br /> <br />(b) The proposal will provide pedestrian circulation to transit stops and <br />neighborhood activity centers located within 1/4 mile of the development site <br />and bicycle circulation to transit stops and neighborhood activity centers located <br />within 2 miles of the development site, provided that the city makes findings to <br />demonstrate consistency with constitutional requirements. The distance <br />between the development site and a transit stop or neighborhood activity center <br />shall be determined using the shortest distance as measured in a straight line <br />between a point along the perimeter of the development site and: <br /> <br />1. A sign identifying a transit stop; or <br /> <br />2. A point along a property line of a neighborhood activity center. <br /> <br />The subject property abuts Hawkins Lane and Randy Lane, which are currently improved with <br />sidewalks on one side of the street that can be used by pedestrians and bicyclists to connect to <br />nearby residential areas. There are no existing transit stops, neighborhood activity centers, <br />office parks or industrial parks within a ¼ mile of the site. The nearest Lane Transit District <br />transit stop is located on Britany Street, approximately 0.88 miles to the northwest. Hawkins <br />Lane is developed with striped bicycle lanes on both sides from Randy Lane north to 18th <br />Avenue, providing safe and efficient bicycle circulation to commercial areas. Videra Park is <br />immediately adjacent to the site along the south border, and Hawkins Heights Park is <br />approximately ½ mile north of the site on Hawkins Lane, also easily accessible to pedestrians <br />and bicyclists. <br /> <br />Based on the findings above, this criterion is met. <br /> <br /> <br /> <br />Page 14 of 87
