Properties across Ohio Street and Burnett Avenue adjacent to the site <br />are developed with single-family residences. <br /> <br />Additional details of the proposal are included in the applicant’s written statement and <br />supporting documentation, all of which are included as part of the public record and located in <br />the application file for reference. <br /> <br />Public Notice and Referrals <br />Public notice of this tentative partition application was provided in accordance with Eugene <br />Code (EC) requirements. A public notice was mailed on November 29, 2021 to all residents in <br />the affected area. No comments were received. <br /> <br />Referral comments were also provided by various City staff and other service providers. These <br />comments are included in the following evaluation with respect to applicable approval <br />standards and are included in the application file for reference. Additional information items <br />are also attached to the end of this decision. <br /> <br />Tentative Partition Evaluation <br />This request is subject to the Type II land use application procedures which are primarily <br />addressed at Eugene Code (EC) 9.7200-9.7230. The following evaluation also addresses details <br />of the proposal in the context of compliance with the applicable approval criteria and related <br />standards. It is noted that the applicant has elected to use the general criteria, rather than the <br />Needed Housing criteria. <br /> <br />In accordance with EC 9.8215, the Planning Director shall approve, conditionally approve, or <br />deny the tentative partition application based on compliance with the listed criteria. Those <br />criteria are provided below (in bold), including findings addressing compliance with each. <br /> <br />EC 9.8215(1) The proposed partition complies with all of the following, unless specifically <br />exempt from compliance through a code provision applicable to a special area <br />zone or overlay zone: <br /> <br />(a) Lot standards of EC 9.2000 through EC 9.4170 regarding applicable parcel <br />dimensions and density requirements. Within the /WR Water Resources <br />Conservation Overlay Zone, no new lot may be created if more than 33% of <br />the lot, as created, would occupy either: <br />1. The combined area of the /WR conservation setback and any portion of <br />the Goal 5 Water Resource Site that extends landward beyond the <br />conservation setback; or <br />2.
