c) Existing neighborhoodcommercial areasshall notbeallowedto <br />expandtogreaterthan1.5acresunlessthedevelopment areasite <br />abuts a collectororarterial street. <br />Theapplicant isproposing justover 1.5 acresofnewneighborhoodcommercialzoningonthe <br />cornerofMaxwellAvenueandtheMaxwellConnector. Theproposaldoesnotexpand anexisting <br />neighborhoodcommercialareaastheexistingcommerciallyzonedareaiszonedC-2Community <br />Commercial. Whilethisstandarddoes notapplytonewC-1areas, even ifitdid, thenew <br />neighborhoodcommercial areaabutsMaxwell Roadwhichisaminorarterial. Basedonthe <br />findingsabove, theproposaltolocateC-1NeighborhoodCommercial, meetsapplicablesiting <br />requirements. <br />EC9.8865(5): Incaseswhere theNRzoneisappliedbasedonEC9.2510(3), theproperty <br />owner shall enter intoacontractualarrangement withtheCitytoensuretheareais <br />maintained asanaturalresource areaforaminimumof50years. <br />Theproposedzonechange doesnotincludetheNRzone; thiscriterion doesnotapply. <br />TransportationPlanning Rule <br />Stafffinds that Goal 12Transportation of theStatewide Planning Goals, adoptedbytheLand <br />Conservation andDevelopmentCommission (DLCD), mustbespecificallyaddressed aspartof <br />therequestedzone change andinthecontextofOregon Administrative Rules, asfollows. <br />Asadopted, OAR660-012-0060(1) states: <br />1)Ifanamendmenttoafunctionalplan, anacknowledgedcomprehensive plan, or <br />alanduseregulation (includingazoningmap) would significantly affectan <br />existingorplannedtransportation facility, thenthelocalgovernment mustputin <br />placemeasures asprovidedinsection (2) ofthisrule, unlesstheamendmentis <br />allowedundersection (3),(9), or (10) ofthisrule. <br />Stafffindsthatthesubject zone changeisgovernedbysubsection (9), whichreadsasfollows: <br />9) Notwithstanding section (1) ofthisrule, alocalgovernment mayfindthatan <br />amendmenttoazoningmapdoesnotsignificantly affectanexistingorplanned transportation <br />facility ifallofthefollowingrequirements aremet. <br />a)Theproposedzoningisconsistentwiththeexisting comprehensiveplanmapdesignation <br />andtheamendment doesnotchangetheplanmap: <br />b)ThelocalgovernmenthasanacknowledgedTSPandtheproposedzoningisconsistent <br />withtheTSP; and <br />Pennington FamilyTrust January 2014 9 <br />Z 13-13) <br />HOAgenda - Page9 <br />278
