c) Theareasubjecttotheamendment wasnotexempted fromthisruleatthetimeofan <br />urbangrowthboundaryamendmentaspermitted inOAR 660- 024-220(1)(d), ortheareawas <br />exemptedfromthisrulebutthelocalgovernmenthasasubsequentlyacknowledged TSP <br />amendmentthataccounted forurbanization ofthearea. <br />Staffconfirms thattheproposedR-2, C-1andGOzoningforthepropertyisconsistentwiththe <br />existingcomprehensive plandesignation asmedium-densityresidentialandcommercialand <br />that this designationwasineffectatthetimetheacknowledged TSPwasadopted (TransPlan <br />2002). WhenTransPlanwasadoptedin2001, thesubject propertywasdesignated Low-Density <br />Residential andhasremainedunchanged. Thesubjectpropertywasnotexempted fromtheTPR <br />atthetimeofanurbangrowth boundaryagreement. Thus, OAR 660-012-0060(9) issatisfied. <br />Basedonthese findings, theproposedzonechangedoesnotsignificantly affecta <br />transportation facility for purposesofthe TPR andthereforecomplieswith the TPR. <br />Staff Recommendation <br />Based on theavailable evidence, andconsistent withthepreceding findings, staffrecommends <br />thatwiththe addition ofthe /SR sitereviewoverlay to the C-1 and GOportion, theHearings <br />Officialapprove therequested zone change to R-2Medium-Density Residential, C-1 <br />NeighborhoodCommercial and GOGeneral Office, while retaining the /WR Water Resource <br />overlay. <br />Consistent with EC9.7330, unless theapplicantagreestoalongertimeperiod, within 15days <br />following close ofthe public record, the EugeneHearings Officialshallapprove, approvewith <br />conditions, ordenythisapplication. Thedecisionshallbebaseduponandbeaccompaniedby <br />findings thatexplain thecriteriaandstandardsconsidered relevant tothe decision, statingthe <br />factsrelieduponin rendering a decision andexplaining thejustificationforthedecisionbased <br />upon thecriteria, standards, andfactssetforth. Noticeofthewrittendecisionwillbemailedin <br />accordance with EC 9.7335. Within 12days ofthedatethedecision ismailed, itmay be <br />appealed to the EugenePlanning Commission as setforthinEC 9.7650through EC 9.7685. <br />Attachments <br />Attachment A: AerialContext Map <br />Theentire application file is available for review atthe EugenePlanning Division.
