Whiletheapplicant isnotresponsible <br />forexistinginfrastructureorforoff-siteimprovements, the25-footspecialsetbackwillfacilitate <br />futureinfrastructureimprovements when theCityproposes them. <br />f) EC9.6775 Underground Utilities. <br />Finding: Incompliance withthisstandard, theapplicant’swrittennarrativestates “Allnew on- <br />siteutilitylineswillbeplaced underground. See sheetC-2.1fromA&OEngineering”. Thesite <br />planincludes anotation that “proposedutilities tobelocated underground perEC 9.6775, unless <br />connectinglegallytoestablishedaboveground facilities.” <br />g) EC9.6780 Vision Clearance Area. <br />Finding: Theproposed developmentdoesnotcreate public orprivate right-of-wayintersections, <br />andthesiteisnotlocated atan existingintersectionand, therefore, thisstandardis not <br />applicable. <br />h) EC9.6791through9.6797regardingstormwater floodcontrol, quality, flow <br />control for headwaters area, oil control, sourcecontrol, easements, and <br />operation andmaintenance. <br />Finding: Theapplicantsubmittedastormwaterreportprepared A&OEngineering andsignedby <br />ScottMorris P.E. toaddressStormwater ManagementStandards. TheJuly13, 2022 staffreport <br />fullyevaluates theproposed developmentforcompliance with eachof thestandardsin EC <br />9.6791through 9.6797, andthestaffevaluationisincorporatedhereandadopted asfindingsof <br />compliance withtheapplicable standards ofEC9.8100(4)(h). <br />i) Anapproved adjustment toastandard pursuanttotheprovisions beginningat <br />EC9.8015ofthislandusecodeconstitutes compliance withthestandard. <br />Finding: Noadjustmentsareproposed. Thisstandard isnotapplicable. <br />Finding: Asnotedabove, inadditiontothoselisted, EC9.8100(4) requires compliancewithall <br />otherapplicabledevelopmentstandards. The applicanthasaddressed compliance withapplicable <br />standardsnotspecifiedin EC9.8100(4) inthisapplication relatedtodensity, setbacks, building <br />heights, andparking. TheJuly13, 2022staffreportfullyevaluates theproposed development <br />forcompliance withthosespecificdevelopment standards, andthestaffevaluation is <br />incorporatedhereandadopted asfindingsofcompliancewith those specificstandards. <br />Priortoapprovalofabuilding permitfor anydevelopment associatedwiththe proposeduse, the <br />applicantmust establishcompliance withanyadditionalapplicable standards notaddressed in <br />thestaffreport. <br />Whilenotobjectingtotheproposeddevelopment, oneconcernedneighborexpressed concerns <br />regardingthecurrent lack ofadequate off- andon-streetparkingintheneighborhood <br />Hearings OfficialDecision (CU21-2) 6 110
