EC9.8100(4): Theproposalcomplies withallapplicable standards, including, but <br />notlimited to: <br />a) EC9.6706Development inFloodPlains throughEC 9.6709Special Flood <br />HazardAreas – Standards. <br />Finding: Thesubject propertyisnot located inaSpecial FloodHazard Areaand, therefore, this <br />standard isnot applicable. <br />b) EC9.6710(6) Geological andGeotechnical Analysis. <br />Finding: Thisstandard requires certification fromalicensed CivilEngineer withgeological <br />experience ora licensed Engineering Geologist thattheproposed development activitywillnot <br />beimpactedbyexisting orpotential stabilityproblems oranyofthefollowingsiteconditions: <br />springsor seeps, depth ofsoilbedrock, variations insoiltypes, oracombination ofthese <br />conditions. Or, ifanyofthese conditionsexist, theengineer mustprovide recommendations to <br />safely address theconditions, andtheapplicant mustsubmit astatementagreeingtodevelop in <br />accordancewiththeengineer’srecommendations. <br />Incompliance with thisstandard, onJuly 12, 2022theapplicant submitted ageotechnical <br />analysisprepared byRonaldJ. Derrick, P.E., G.E., thatconcludesthattheproposed development <br />willnot beadversely impacted bytheconditions listedinEC9.6710(6) ifdesigned and <br />constructed inaccordance withgenerallyacceptedpracticesforgeotechnicalengineering inthe <br />Eugenearea. <br />c) EC9.6730 Pedestrian Circulation On-Site. <br />3) PerEC9.6730DesignofOn-SitePedestrian Facilities. Allon-site <br />pedestrian pathsprovided forthepurposesofcomplyingwiththis landuse <br />codeshall conformwiththefollowing standards: <br />a) On-sitepedestrianpathsshallprovidedirect access frompublic <br />waysto buildingentrances. <br />Finding: Theapplicant’sJune 14, 2022siteplandepictsdirect accessfrompublicways to <br />buildingentrances viadirect connections orviacrosswalks. <br />b) On-sitepedestrianpathsshall beconstructed of concrete, a <br />comparable hardsurfacematerial, oranypropertydesigned <br />pervious surfacethatcomplies withtheAmericans with <br />Disabilities Act. <br />Finding: SheetC-3.1oftheapplicant’ssite plannotes thatsidewalks and pathswill be <br />composedof 3000PSIconcrete, whichcomplieswiththisstandard. <br />Hearings OfficialDecision (CU21-2) 4 108
