SiteCharacteristics <br />Thesubject propertyisapproximately 1.88acresinsizeandislocatedatthenortheast corner of <br />theintersectionofAutumn Avenue andRossLane, south ofHelenStreetandwestofKlamath <br />Street. The propertyis identifiedasMap No./TaxLot17-04-12-34/00500. Theproperty iszoned <br />R-1 Low Density Residentialand is currently vacant. It is surrounded byadeveloped <br />neighborhoodofsingle- and multi-familyresidences. <br />C. Description ofRequest <br />Theapplicant proposestodevelopthesubject propertyas a39-bed assisted grouplivingcare <br />facility. Thefacility isproposed to consist ofthreeseparatebuildings, eachcontaining13beds. <br />Assisted carefacilities are allowed intheR-1 LowDensity Residential zone, subject toan <br />approved conditionalusepermit. <br />D. Evaluation ofRequest <br />The applicant requests approvalofaNeededHousingConditional UsePermitforan Assisted <br />GroupLiving Facility. Eugene Code (ECSection 9.8100) requiresevaluation ofanapplication <br />foraconditionalusepermit undertheneededhousingcriteriaforcompliance withthefollowing: <br />EC 9.8100(1): Theapplicant hasdemonstrated thattheproposedhousing isneeded <br />housing asdefinedbyStatestatutes. <br />Finding: Oregon Revised Statutesdefineneededhousingasfollows: <br />1) AsusedinORS197.307, “neededhousing” meansallhousingonlandzoned <br />for residential use or mixed residentialand commercial usethatisdetermined to <br />meettheneed shown forhousingwithinan urbangrowthboundary atpriceranges <br />andrentlevelsthat areaffordabletohouseholds withinthecountywithavariety <br />ofincomes, includingbutnot limitedtohouseholdswithlowincomes, verylow <br />incomesandextremelylowincomes, asthosetermsaredefined bythe United <br />StatesDepartment ofHousing andUrban Development under42 U.S.C. 1437a. <br />Needed housing” includesthefollowing housingtypes: <br />a) Attached anddetached single-familyhousing andmultiple family <br />housing forbothownerandrenter occupancy; <br />b) Governmentassistedhousing; <br />c) MobilehomeormanufactureddwellingparksasprovidedinORS <br />197.475to197.490; <br />d) Manufactured homes onindividuallotsplanned andzonedforsingle- <br />familyresidential usethatareinadditiontolotswithin designated <br />manufactureddwellingsubdivisions; and <br />e) Housing forfarmworkers. <br />2) Subsection (1)(a) and (d) ofthissectiondoesnot applyto: <br />a) Acitywithapopulation of lessthan 2,500. <br />Hearings OfficialDecision (CU21-2) 2 106
