EC 9.6830 Intersections for Streets and Al <br />(1) Angles. <br />The proposed street intersections are configured at or near 90-degree angles as required by <br />this standard. <br />(2) Offset. <br />The minimum offset distance for Collector streets, which Scenic Drive is, is 200 feet. The <br />applicant's written narrative states the intersection offset distance from the proposed Buster <br />Lane to Kidare Street is approximately 160 feet, which does not comply with the 200 foot <br />minimum offset. <br />The applicant has applied for an adjustment to this section per EC 9.8030(12) and requested <br />concurrent evaluation with this tentative subdivision decision. The written narrative for said <br />adjustment was submitted by The Favreau Group, LLC and stamped by Anthony J. Favreau, P.E., <br />the proposed intersection spacing will operate in a safe and efficient manner due to the <br />adequate sight distances for the opposing streets, in compliance with the adjustment review <br />criteria addressed later in the decision. Based onthe approved adjustment, this standard is met. <br />EC 9.6835 Public Accessways: This standard does not apply as there are no existing or potential <br />accessways on adjacent sites that dictate the dedication or construction of a public access way. <br />EC 9.6840 Reserve Strips: EC 9.6840(6) enables the City to require the developer to dedicate a <br />reserve strip preventing access to an arterial or collector street when such access would be <br />inconsistent with EC 7.420. Pursuant to EC 9.6735 and EC 7.420(1)(c), the existing access <br />connection to 3915 Scenic Drive was previously permitted and will be allowed to remain, <br />however no additional access to Scenic Drive will be permitted. To ensure compliance, the <br />following condition is necessary: <br />• On the final plat, the applicant shall create an access restriction strip along the entire <br />frontage of Scenic Drive, with the exception that the existing access connection to the <br />house at 3915 Scenic Drive shall be excluded from the access restriction strip. <br />EC 9.6840(6) enables the City to require the developer to dedicate a reserve strip controlling <br />access to a street when necessary to prevent access to an arterial or collector streets when <br />such access would be inconsistent with EC 7.420. Per the findings at EC 9.6735(2) and <br />EC7.420(1)(c), access from Lot 1 must be taken from Buster Lane, rather than Scenic Drive, a <br />neighborhood collector.
