The subject site is not located in an area subject to the requirements of the /WR or /WQ <br />overlay zones. Additionally, the /CAS Commercial Airport Safety Overlay does not establish <br />additional standards that would require review for approval of a residential subdivision. <br />Two points of testimony concern lot size, density, and setbacks. One point written by Barbara <br />Hurwich states the following concern, "We would also like to see a set back so the new <br />subdivision is not built right up against the street, to preserve the current green atmosphere of <br />the neighborhood." <br />The other point of testimony is by Carole Grappo stating: <br />"Also, the design does not harmonize with the general quality of country like living. This <br />area is mostly single-family homes with some duplexes, with nice yards with greenery <br />that helps us to breathe. 1 do not see how this proposal will favor green space at all. <br />Please reconsider what this kind of cramming single family dwellings on small lots will do <br />to the neighborhood." <br />The proposed lots meet the minimum lot size area for the R-1 zone. At the time of building <br />permit review, development will be reviewed for compliance with the R-1 zone setbacks (as <br />addressed in EC 9.2750). As previously stated, the proposed density of the subdivision is below <br />the density maximums for the R-1 zone. <br />Based on the available information and findings above, EC 9.8520(3)(a) is met. <br />(b) EC 9.6800 through EC 9.6875 Standards for Streets, Alleys, and Other Public Ways. <br />The standards listed by EC 9.6800 through EC 9.6875 detail the dedication, design, and location <br />of public ways. Referral comments from Public Works staff provide findings and evaluation for <br />each of the standards listed by the criterion above, noting that some are not applicable to this <br />application. Relevant excerpts and findings are provided below, and the full referral comments <br />are available in the application file for reference. <br />EC 9.6805 Dedication of Public Ways: The City may require dedication of public ways, provided <br />the City makes findings to demonstrate consistency with constitutional requirements. Public <br />ways to be dedicated to the public by the applicant must conform with the adopted Street <br />Right of Way Map and EC Table 9.6870. When a street segment is not designated on the street <br />right-of-way map, EC 9.6870 provides that "the required street width shall be the minimum <br />shown for its type in Table 9.6870 Right-of-Way and Paving Widths unless a greater width is <br />approved by the planning director and public works director based on adopted plans and <br />policies, adopted 'Design Standards and Guidelines for Eugene Streets, Sidewalks, Bikeways and <br />Accessways' or other factors which in the judgment of the planning and public works director <br />allow for a lesser street width." <br />July 2022 Findings & Decision of the Planning Director Page 5 of 22 <br />Buster Place (ST 22-1) <br />
