The subject property is in an area designated for Low Density Residential development by the <br />comprehensive plan diagram. The comprehensive plan currently assumes that areas designated <br />for Low Density Residential are appropriate for up to 10 units per gross acre (see page II-G-3). <br />The applicant's proposal to create 11 residential, buildable lots and one lot for stormwater <br />treatment will provide a density of 6.04 units per gross acre (11 units on 1.82 acres). As the <br />applicant's proposal is within the allowed 10 units per gross acre, the proposal is consistent <br />with the comprehensive plan. The subject property is also located in the River Road - Santa <br />Clara Urban Facilities Plan, which further identifies the site as appropriate for Low Density <br />Residential. <br />Based on the available information, EC 9.8520(2) is met. <br />EC 9.8520(3): The proposed subdivision complies with all of the following, unless specifically <br />exempt from compliance through a code provision applicable to a special area zone or <br />overlay zone: <br />(a) EC 9.2000 through 9.3980 regarding lot dimensions and density requirements for the <br />subject zone. Within the /WR Water Resources Conservation Overlay Zone or /WQ <br />Water Quality Overlay Zone, no new lot may be created if more than 33% of the lot, <br />as created, would be occupied by either: <br />1. The combined area of the /WR conservation setback and any portion of the <br />Goal 5 Water Resource Site that extends landward beyond the conservation <br />setback; or <br />2. The /WQ Management Area. <br />The density standards for property zoned R-1 are set by EC Table 9.2750 Residential Zone <br />Development Standards. The maximum density is set at 14 units per net acre for the R-1 zone. <br />The applicant's site totals 1.36 net acres. The proposed 11 units will result in 8.1 units per net <br />acre under the 14 unit per net acre density maximum. <br />The applicant's proposal includes 11 residential lots. Requirements for lot dimensions for lots <br />on property zoned R-1 are set by EC 9.2760 Residential Zone Lot Standards. The minimum lot <br />size is set at 4,500 square feet with a minimum width and frontage of 50 feet. Each proposed <br />lot contains more than 4,500 square feet of area and has a minimum lot width greater than 50 <br />feet. <br />Additionally, the applicant's proposal consists of a tentative subdivision in the R-1 zone and is <br />thereby subject to EC 9.2790 Solar Lot Standards. The standards require that at least 70% of the <br />lots in the subdivision be "solar lots" with a minimum north-south dimension of 75 feet. The <br />applicant's written narrative notes that all lots have a minimum north-south dimension of 75 <br />feet, which is further evidenced by their site plan.
