intends to request a permit to begin grading the site prior to final plat approval. These <br />standards can be met. <br />(4) Sidewalks. Sidewalks shall be located, designed and constructed according <br />to the provisions of this land use code, the Design Standards and Guidelines <br />for Eugene Streets, Sidewalks, Bikeways and Accessways, construction and <br />design standards adopted pursuant to Chapter 7 of this code, and other <br />adopted plans and policies. <br />Response: The private street is designed to meet the local street standard for a two-way alley <br />contained in the Design Standards and Guidelines for Eugene Streets, Sidewalks, Bikeways <br />and Accessways pursuant to Chapter 7 of this code. This includes a sidewalk on one side <br />of the street per the advice from the City provided at the pre-application conference <br />which will provide multi-modal options to future residents. This standard is met. <br />(5) Bicycle Paths and Accessways. Bicycle Paths and Accessways shall be <br />designed and constructed according to provisions of this land use code, the <br />Design Standards and Guidelines for Eugene Streets, Sidewalks, Bikeways <br />and Accessways, construction and design standards adopted pursuant to <br />Chapter 7 of this code, and other adopted plans and policies. <br />Response: The project does not propose or warrant construction of new bicycle paths and or <br />accessways. The layout is a minor modification to the layout approved for the lot under <br />PDF 02-2. The preliminary layout was approved which was approved without bicycle <br />paths or accessways. Therefore, the submitted layout is consistent with the layout <br />approved under the PUD. This standard is not applicable. <br />Site Development Standards <br />9.6775 Underground Utilities. <br />(1) Exemptions from Underground Utility Standards. The following are exempt <br />from the undergrounding requirement of this section: <br />(a) Temporary uses on a development site. <br />(b) New utility connections to structures or buildings with legally <br />established above ground utility service. <br />(c) Accessory dwellings that can be served from an existing legally <br />established above ground utility service to the primary dwelling on <br />the development site. <br />(d) Dwellings on alley access lots that can be served from an existing <br />above ground utility-owned structure. <br />(2) Underground Utility Standards. All new on-site utilities shall be placed <br />underground if there is a utility-owned structure immediately adjacent to the <br />development site, unless adjusted pursuant to the provisions of EC 9.8030(5). <br />This requirement is satisfied if the applicant verifies in writing that utilities <br />will be placed underground concurrent with planned future development to <br />occur within 12 months. Exceptions shall be made for such features as pad <br />mounted transformers, switch cabinets, back flow prevention devices and <br />closures needed to safely operate and maintain utility systems. <br />Response: Planned utilities will be placed underground as shown on the Preliminary Composite <br />Utility Plan in Exhibit A.
