University of Oregon <br />Indoor Football Practice Facility <br />Willamette Greenway Permit Application <br />6.0 APPROVAL CRITERIA AND STANDARDS <br />6.1 Willamette Greenway Permit Criteria (EC 9.8815) <br />September 23, 2021 <br />The project site is within the boundaries of the Willamette River Greenway. <br />Intensifications of uses, changes in use, or new developments within the Greenway <br />require Willamette Greenway permit approval. The proposed project is considered an <br />intensification of use and new development. <br />Proper evaluation of this proposal must consider the criteria for development within <br />the context of EC 9.8815, which defines the qualifying term "to the greatest degree <br />possible" as follows: <br />As used in this section, the words "the greatest possible degree "are drawn from <br />Oregon Statewide Planning Goal 15 (F.3.b.) and are intended to require a <br />balancing of factors so that each of the identified Willamette Greenway criteria is <br />met to the greatest extent possible without precluding the requested use. <br />Goal 15 (C.3.) provides that "lands committed to urban uses within the <br />Greenwayshall be permitted to continue as urban uses..." <br />Hearings Official approval of the prior Greenway permit application for development of <br />the Moshofsky Center and outdoor athletic fields (WG 96-4) also considered this <br />criterion within the context of established case law: <br />In Stotter v. City of Eugene, 18 Or LUSA 135 (1989) the language ofa similar <br />Eugene provision was construed. The Board determined that the standard does <br />not mean that a proposed use in the Greenway has to be set back to the <br />greatest possible degree but that, once the development is located according to <br />the Willamette Greenway setback requirements and any local plan or land use <br />regulation requirements, 'the maximum possible landscape area, open space <br />and vegetation must be provided between the activity and the river.' Under this <br />interpretation of the language of the criterion, the indoor practice facility and <br />the parking on the south side of the facility can be located at the southern <br />portion of the University of Oregon property. " <br />Within the context of the above definition and interpretation, approval of a Willamette <br />Greenway Permit under EC 9.8815 requires findings of compliance with the following: <br />EC 9.8815: Willamette Greenway Permit Approval Criteria and Standards. <br />Willamette Greenway permit approval may be granted only if the proposal <br />CAMERON MCCARTHY 20 <br />
