<br />Zone Change (City File # Z 20-8): Amends the existing base zone from I-2 Light- <br />Medium Industrial with partial /SR Site Review Overlay to S-W Whiteaker Special <br />Area Zone with a /SR Overlay Zone. The proposed zoning would implement the <br />related land use designation change to Mixed Use. <br /> <br />As a reminder, the land use applications proposed in this City-initiated adoption package are <br />subject to formal quasi-judicial procedures at EC 9.7065-9.7095, so if there are any declarations <br />or disclosures related to conflict of interest or ex-parte contact, commissioners should provide <br />those at the outset of our next meeting. As previously discussed, the applications are subject to <br />review according to the approval criteria for each application type, and the Commission’s <br />recommendation must be based on the available evidence in the record. <br />SUMMARY OF PLANNING COMMISSION PROCEEDINGS <br />Prior to the Planning Commission public hearing, staff received one piece of testimony <br />submitted jointly by the Housing Land Advocates (HLA) and the Fair Housing Council of Oregon <br />(FHCO). The Planning Commission held a public hearing on January 26, 2021, during which <br />Planning staff gave a brief presentation, testimony was provided by the applicant, and <br />testimony was received from several other interested parties. <br /> <br />Initial Open Record Period Extension <br />Prior the close of the public hearing, Planning Commission received a request to extend the <br />open record period, consistent with State law (ORS 197.763). A brief summary of additional <br />materials received during the open record period is provided below. At the public hearing on <br />January 26, 2021, the record was requested to be held open for any interested party to submit <br />new evidence and testimony for consideration as part of the Commission’s deliberations. All <br />parties agreed to a seven-day period to allow new written testimony and evidence followed by <br />a subsequent seven-day period for written testimony in response to all arguments and <br />evidence already in the record. A final seven-day period was provided for the applicant to <br />provide any final written rebuttal.
