Second Open Record Period Extension
Based off the testimony and commissioners’ public hearingcomments, staff identified an error
contained within the applicant’s TPR analysis assumptions. In order to allow the applicant an
opportunity to revise their assumptions and to provide ample opportunity for interested parties
to review the applicant’s revised TPR analysis, staff recommended the Planning Commission
reopen the public record.
On February 22, 2021, Planning Commission reopened the public record. All parties agreed to a
fourteen-day period to allow new written testimony and evidence followed by a seven-day
period for written testimony in response to arguments and evidence already in the record,
followed by a final seven-day period for the applicant to provide final written rebuttal. Below is
a brief summary of the additional materials received by staff during the open record period:

Second Open Record Period (February 22—March 8, 2021)
Applicant Trip Generation Cap Memorandum, submitted by Kelly Sandow,
Sandow Engineering, dated March 1, 2021
Email with letter attachment from Fred Tepfer, dated March 8, 2021

Second Open Record Response Period (March 8—March 15, 2021)
Applicant Response Memorandum, submitted by Kelly Sandow, Sandow Engineering,
dated March 15, 2021
The admissible items listed above have been provided separately via email to the Planning
Commission and are posted on the City’s website for public viewing at:
https://pdd.eugene-or.gov/LandUse/SearchApplicationDocuments?file=MA-20-0002
The full set of application materials and other information in the record to date has been
provided to the Planning Commission for consideration. Those materials are also available at
the web address above or upon request from the assigned planner. Please contact Rodney
Bohner, Associate Planner by phone: (541) 682-5437 or e-mail: RBohner@eugene-or.gov for
questions about accessing the materials for this application.
TRANSPORTATION PLANNING RULE ANALYSIS
Testimony received during the second open record period (February 22 to March 22, 2021)
focuses on the applicant’s revised TPR and trip cap analysis. Based on the applicant’s revised
reasonable worst-case scenario, staff recommends Planning Commission revise the proposed
trip cap condition of approval from 453 PM peak hour tripsto 328 PM peak hour trips. Findings
supporting staff’s recommendation are included in the revised preliminary findings (see
Attachment C).

STAFF RECOMMENDATION
The Planning Commission must address the relevant approval criteria from EC 9.7735, 9.8424,
and EC 9.8865 in making a recommendation to the City Council on the request.
