Comcast. Please provide updated forms or documentation that the companies were given clear <br />indication of where the proposed PUE vacation is occurring. <br />c. The condition requested from Century Link (Qwest) is not something the City can enforce or <br />condition. You will need to provide a response to their condition demonstrating how you will <br />meet their conditions of approval. This will need to be a private arrangement between you and <br />Qwest. Please contact Qwest and get them to confirm that they are ok with not having an <br />easement, as you propose. Their requested condition is not something the City can be <br />responsible for. (REQUIRES AMENDMENT) <br />15. There is no evidence provided that shows this has been met. Attached is the email explaining the <br />ORS that was sent to the applicant. Please review that and use the Vacation Consent form provided on <br />our website: https://www.eugene-or.gov/2040/Fees-and-Forms . Please include a table of affected area <br />property owners, indicate who has signed, and how you meet the 2/3s rule. <br />a. Perhaps I missed something in your re-submittal because you note in your memo that "all <br />signatures have been acquired". I do not see any evidence that this information was provided <br />within the materials. I am happy to discuss this further, but I do not think I can make it any more <br />clearly based on the information provided in the last round of completeness review. The maps <br />do clearly identify which properties are affected by the vacations. However, without a table or <br />supplemental information to demonstrate that 2/3s of owners consent to the vacation, there is <br />no way for us to know if you have reached that threshold. Further, no vacation consent forms <br />have been submitted by affected property owners. I covered this in detail in my previous <br />completeness review. I have created a table for you, in order to help facilitate understanding. <br />See attached.
