• <br />• <br />Section 9.060(k) of the Eugene Code addresses conservation land divisions. No conservation <br />land division is proposed as part of the subject application. <br />Section 9.065: Drainage <br />Section 9.065 of the Eugene Code addresses platting standards for drainage, and provides that, <br />where necessary, the Planning Director may require the dedication of drainage easements to <br />ensure adequate and unrestricted drainage. The are no known drainage features on the subject <br />site that would require consideration under this standard, except for the temporary drainage ditch <br />proposed by the applicant. Public Works Engineering staff have commented that the proposal <br />includes appropriate easements for this facility, and that dedication of the necessary easements <br />will be addressed in a Public Improvement Construction Agreement. <br />Section 9.070: Railroads <br />Section 9.070 of the Eugene Code addresses standards for railroad crossings and subdivisions <br />adjacent to railroad right-of-way. Based on the absence of these facilities in the general area, this <br />standard is not applicable to the subject request. <br />Section 9.073: Restrictions of Record <br />Section 9.073 of the Eugene Code addresses restrictions of record for solar access protection. <br />Because there are no known lots adjacent to the subject site with protected solar access, this <br />standard is not applicable. <br />Section 9.080: Unsuitable Areas <br />Section 9.080 of the Eugene Code addresses unsuitable areas. The site is known to contain <br />wetlands which are designated for development on the West Eugene Wetland Conservation Plan <br />Inventory. Public Works Engineering staff comment that connection to the existing sewer will <br />require that permits for work within jurisdictional wetlands be obtained. The proposal will also <br />require permits for any storm drainage work within jurisdictional wetlands. The applicant will be <br />required to provide documentation that necessary State and Federal Permits for work within the <br />wetlands have been obtained, or provide adequate verification that such construction can be done <br />under a nationwide exemption. With these requirements, the proposal will comply with the <br />applicable standard. <br />Section 9.030(4)(b)(1): Approval does not impede or adversely affect the safe and <br />healthful development of any adjoining land or access thereto. <br />The proposed partition will not impede or adversely affect the safe and healthful development of <br />any adjoining land or access thereto.
