UNIVERSITY OF OREGON <br />NORTH CAMPUS <br />CONDITIONAL USE & WILLAMETTE GREENWAY PERMIT APPLICATION <br /> <br />(a) All structures, parking areas, streets, and access drives shall <br />maintain a minimum setback of 35 feet from the top of the south <br />bank of the Willamette River. A map indicating the location of the <br />top of the south bank is on file with the cityÈs planning and <br />development department. <br />EC 9.3715 specifies that the development standards in the S-RP Zone supersede any conflicting <br />provisions with the general standards. The /WR Water Resources Conservation Overlay Zone <br />applies a 100-foot conservation setback to the Willamette River and a 40-foot conservation <br />setback to the Millrace, as measured from the top of bank. According to the provisions at (2)(a) <br />above, the Applicant could propose development, including structures, parking areas, streets, and <br />access drives, beginning at 35 feet from the top of bank of the river. <br />As illustrated on Sheet L01 Regulatory Plan (Exhibit A), the proposal includes a required 100-foot <br />conservation setback extending from the Willamette River and Millrace top of bank lines. Further, <br />the Applicant proposes a riparian enhancement setback of 200-feet for buildings and recreational <br />fields along most of the length of the property, as shown on Sheet L01 Regulatory Plan. Since this <br />200-foot setback is determined from the top of bank, the setback equates to 250-300 feet as <br />measured from the waterÈs edge. Based on the above findings, and because the proposal does <br />not involve development within 35 feet of the top of bank, this standard is satisfied. <br />(b) All structures, parking areas, streets, and access drives shall <br />maintain a minimum setback of 15 feet from the south side of the <br />bicycle path located (or as to be relocated) adjacent to the top of <br />the river bank. If the setback specified herein requires a greater <br />distance than the 35 feet specified under Section 9.3715(2)(a), the <br /> <br />greater distance shall be maintained. <br />As illustrated on Sheet L02 Site Plan (Exhibit A), the proposal includes two options for realignment <br />of the bicycle path referenced in (2)(b) above. Sheet L02 Site Plan further illustrates that all <br />proposed structures, parking areas, street, and access drives are more than 15 feet from the south <br />side of the alignment options. Therefore, this standard is satisfied. <br />(c) Solar access shall be provided to at least 60 percent of the following <br />designated areas: <br />1. The south bank of the Willamette River. <br />2. The bicycle path located (or as to be relocated) adjacent to the <br />top of the river bank. <br />3. The Autzen Stadium footbridge protection area defined in <br />Section 9.3715(2)(e) below. <br />4. Active recreation areas defined in the master site plan. <br />The solar access required herein shall be provided at noon from <br />February 21 to October 21 of any year.
