The applicant states that they are obligated to consider the preservation of trees on the site, but <br />are not required to preserve any of the trees. The applicant provides a survey and materials which <br /> <br /> <br />(b) <br /> <br />protected. <br /> <br />Staff confirms the applicant statement that no natural resource areas as designated on the <br />Metro Plan diagram are located on the site. <br /> <br />Based on these finding, EC 9.8445(3) is met. <br /> <br />EC 9.8445(4): The proposal complies with all of the following standards: <br /> <br />(a) EC 9.2000 through 9.3980 regarding lot dimensions and density <br />requirements for the subject zone. <br /> <br />The minimum density for the subject site is 15 units per net acre as established by the /ND Nodal <br />Development Overlay zone at EC 9.4290 Density and Development Standards. The R-2 base zone <br />of the subject site provides that a maximum density of 28 units per acre is allowed (see EC Table <br />EC 9.2750 Residential Zone Development Standards). <br /> <br />The applicant states that 99 units on 3.55 acres would equal 28 units (per acre), and as the request <br />is for only 94 units, it complies with density. The applicant also provides a calculation on sheet A1 <br />of the May 11, 2018 application materials. The calculation identifies the entire site area as being <br />3.59 acres, subtracts the .21 acres to be dedicated for Lombard Street, and concludes that 94 units <br />is the maximum density considering 28 units per net acre is allowed. <br /> <br />The applicant has not proposed land division with this application, nonetheless, the applicant <br />states that the proposal complies with the minimum lot size of 4,500 square feet for R-2 property. <br /> <br />Based on the available evidence, this criterion is met. <br /> <br />(b) EC 9.6500 through 9.6505 Public Improvement Standards. <br /> <br />EC 9.6500 Easements: This section authorizes the City to require dedication of easements for <br />public utilities and access. Public Works referral comments note that the applicant has proposed a <br />15 foot public utility easement to accommodate water and stormwater facilities.
