facilities which require compliance with EC 9.6792(2)(d), which is discussed in further detail per <br />the findings at EC 9.6792 and is incorporated herein by reference. <br /> <br /> <br />EC 9.8445(5): Public improvements as required by this land use code or as a condition of <br />tentative plan approval have been completed, or a performance bond or petition for public <br />improvements has been submitted and accepted. <br />The proposed public street, wastewater, and stormwater systems will be constructed through the <br />Privately Engineered Public Improvement (PEPI) process. As an informational item, staff notes <br />that the PEPI permit will need to be approved and bonded prior to the issuance of building <br />permits for development on the site. <br /> <br /> <br />Public Works staff recommends the following conditions of approval: <br /> <br />The following restriction will be required to be shown on the Final Site Plan in accordance <br /> <br />located on or in a Pub <br /> <br />The proposed Public Utility Easement will be conveyed by a separate document meeting <br /> <br />City standards in conjunction with the Privately Engineered Public Improvement (PEPI) <br />process. <br /> <br />Prior to issuance of an occupancy permit, the applicant shall obtain approval of a PEPI <br /> <br />permit for the construction of Lombard Street and any associated infrastructure that will <br />be public. <br /> <br />A street deed to convey the right-of-way for Lombard Street will be submitted in <br /> <br />conjunction with the PEPI permit process. <br /> <br />In conjunction with the PEPI process, the applicant shall submit a street tree agreement <br /> <br />application with a street tree plan to the City Urban Forester for review. Approval of the <br />agreement will be required prior to PEPI approval. <br /> <br />Prior to Final Site Plan approval, a final geotechnical analysis, signed and stamped by the <br /> <br />appropriate design professionals, shall be submitted. As an alternative, the applicant shall <br />submit certification per EC 9.6710(6).
