17. The final PUD plans shall show that the stormwater runoff on the north and south ends of <br />the additional Capital Drive road width will be treated through either filtration or <br />mechanical treatment methods in compliance with the Public Improvement Design <br />Standards manual. <br />18. The final PUD plans shall show that the stormwater runoff on the north and south ends of <br />the proposed private street will be treated through a filtration facility in compliance with <br />the Stormwater Management Manual. <br />19. Prior to final PUD approval, all requirements of EC 9.2750 Residential Zone <br />Development Standards, including Table 9.2750 and EC 9.2751 Special Development <br />Standards for Table 9.750, shall be met regarding the existing structure located on Lots <br />33 and 34. <br />20. The Written Owner Commitment to Fund Water Infrastructure executed by the applicant <br />shall be re-executed to clarify that the Commitment applies to the entire subject property, <br />including Tax Lot 201. <br />A. Background <br />The applicant, Cynthia and Tom Dryer (applicant) submitted the subject tentative Planned Unit <br />Development (PDT) application on March 3, 2017. The applicant submitted supplemental <br />application materials on or about June, 19, 2017, August 22, 2017, September 15, 2017, October <br />27, 2017, November 28, 2017, January 26, 2018, and March 7, 2018. The city deemed the <br />application complete on August 29, 2017. Public hearings originally noticed and scheduled for <br />November 1, 2017 and January 10, 2018 were cancelled and postponed. <br />Following public notice, a public hearing was held on March 7, 2018. The public hearing began <br />with the hearings official's explanation of the hearing process and the statutory and local <br />procedural requirements for the hearing.' The hearings official noted that because of the <br />anticipated volume of public testimony, individual public testimony would be limited to five <br />minutes per individual. In addition to individual public testimony, the Joint Response Committee <br />comprised of representatives from the Fairmount Neighbors Association and Laurel Hill Valley <br />Citizens, was provided 30 minutes to provide its testimony. The hearings official denied a <br />written request received before the hearing to allow Paul Conte to orally question Scott Gillespie, <br />the City's Public Works Development Review Manager, or other staff, regarding the substance <br />of Mr. Gillespie's written comments. <br />iThe hearing official's explanation included a statement that she has had no ex parte contacts regarding the <br />application and has no personal or financial interest in the subject property. The hearings official notes that is <br />possible that during the open record period, an individual unknown to the hearings official attempted to make an ex <br />parte contact with hearings official through a communication on the hearings official's Linkedln account. Upon <br />noticing that the communication was from an individual in Eugene and referenced Henricks park, the hearings <br />official closed the communication without reading it. That attempted communication is not part of the record and the <br />hearings official did not read or otherwise consider it as part of the evaluation of this application. <br />Hearings Official Decision (PDT 17-1) 4 <br />
