EC9.8320(8).ResidentsofthePUDwillhavesufficientusablerecreationareaandopen <br />spacethatisconvenientandsafelyaccessible. <br />The8/22/17ApplicationstatesonP.47of67: <br />“Over80acresofHendricksPark,whichconnectsintotheRibbonTrail,abutsthe <br />proposedPUD.Residentscouldn’tgetanyclosertothissuperbrecreationexperience. <br />AshortwalktotheendofCapitalDriveandresidentswillbeinthepark,whichis <br />accessibletobicyclistsandpedestriansonly.” <br />AccesstotheRibbonTrail:ThereisnodirectRibbonTrailaccessfromtheproposedPUD. <br />TheproposedpreservationareabetweenLots13&14(partofCommonPreservationAreaTract <br />A)isapproximately185feetlongand38feetwidewithanestimated37%slope,whichisfartoo <br />steeptouse.AtthepointwherethispartofthePUD’sCommonPreservationAreameetsthe <br />CityofEugene’sforestedareatothewestoftheRibbonTrail,theslopegetssteeper <br />(approximately53%).Additionally,a“6footagriculturaltype”fenceisproposedalongthe <br />project’sentireeasternboundaryabuttingtheCity’sforestedarea.(Seecommentsbelow.) <br />Thus, <br />1)ThispotentialroutetotheRibbonTrailisobviouslyimpassableandunsafe;and <br />2)Evenifthisrouteweresaferandmoreaccommodating,thelargeimpassablefence <br />preventsanyaccesstotheRibbonTrailfromthispotentialroute. <br />Alternatively,theapproximately25footwidestripoflandatthesouthernboundaryofthe <br />proposedPUD(alsopartofCommonPreservationAreaTractA)isapproximately405feetlong <br />andhasaverysteep42%slope.ThispotentialaccessroutetotheRibbonTrailisunimproved, <br />heavilywoodedandextremelydangerous.ItisalsonotviableaccesstotheRibbonTrail. <br />Notethat,inearly2017,theApplicantproposedgrantingthisstripoflandtotheCityofEugene <br />foruseasaccesstotheRibbonTrail.Becauseofthesteepnessofthisland,theCitydeclinedthe <br />donationunlesstheApplicantincludedtwoadjoininglots(Lots18&19)aspartofthegranted <br />land.ThesetwolotswouldhavemadethisRibbonTrailaccessroutesafebyprovidingabout <br />170feetinadditionalwidthforswitchbacks.Inresponse,theApplicantdeclinedtheCity’s <br />requestfortheadditionallandand,consequently,todaythisstripoflandremainsunusable. <br />NotethattheResponseCommitteerequesteddocumentationfromCityPlanningregardingthe <br />City’sdeclinationofthe25footstripoflandattheproposedPUD’ssouthernborder.City <br />PlanningindicatedthattheywouldaddressthissubjectintheirStaffreport;however,the <br />ResponseCommitteecannotlocateanywhereintheStaffReportthattheyhavedoneso. <br />Asmentionedabove,anadditionaloverridingfactorregardingaccesstotheRibbonTrailforthe <br />residentsoftheproposedPUDisthatonSitePlanL2.0dated1/19/18,theconstructionofa6 <br />foothighfenceisindicated.Thisfencewouldbebuiltalongtheentireeasterlyperimeterofthe <br />proposedproject,andwouldalsopartiallyextendupthenorthernandsouthernperimetersofthe <br />property.Thereisnoevidentpedestrianpassthroughinthisfence.TheCommitteecannot <br />86 <br /> <br />
