Based on these findings, there are no requirements for additional right-of-way or special setbacks. <br />EC 9.6873 Slope Easements <br />Slope easements may be required to facilitate the construction of streets and alleys and to <br />protect the structural integrity of the roadway. Per the geotech report (Section 5.4), cut and fill <br />slopes "are expected for the construction of the roadways accessing the site". Staff notes that <br />that private construction consistent with building codes and standards may be permitted within <br />the slope easements at the time of the building permits. Staff acknowledges that the extent of <br />the easements will not be known for certain until the PEPI permitting process. Therefore, in order <br />to ensure compliance with this standard, the following condition is warranted: <br />On the final plat, the applicant shall dedicate public slope easements for any fills or cuts <br />that extend beyond the public right-of-way. The final plat shall be consistent with the <br />approved PER plans. <br />As an informational item, staff notes that that private construction consistent with building codes <br />and standards may be permitted within the slope easements at the time of the building permits. <br />9.6875 Private Street Design Standards <br />These standards do not apply because private streets are not proposed. <br />(c) EC 9.6500 through EC 9.6505 Public Improvement Standards <br />9.6500 Easements (Public) <br />This section authorizes the City to require dedication of easements for public utilities and access <br />under certain circumstances. Per the tentative plan, a 7-foot wide PUE is proposed along the <br />Spring Boulevard frontage. <br />Otherwise, the applicant does not propose nor has Public Works staff identified the need for <br />additional public easements to address stormwater or wastewater needs for present or future <br />development of the area. <br />As an informational item, pursuant to EC 9.6500(3), if any public utility easements are shown on <br />the final plat, the plat shall note the following restriction: No building, structure, tree, or other <br />obstruction shall be placed or located on or in a public utility easement. <br />Staff also notes that a current title report must be submitted with the final plat. The final plat <br />must show all easements and restrictions listed in the title report, and interest-holders must sign <br />the Declaration or submit concurrences. Additionally, all existing City liens or assessments must be <br />paid prior to final plat approval. <br />Based on these findings, the partition complies with EC 9.6500. <br />PT17-07 Furtick - PW Referral Page 4 of 11 <br />
