Capital Hill PUD <br />Planned Unit Development Application - Tentative Stage - Written Statement <br />Lot 29 <br />95+ feet on <br />Street A <br />Lot 30 <br />95+ feet on <br />Street A <br />Lot 31 <br />82+ feet on <br />Street A <br />Lot 32 <br />140+ feet on Street A <br />Lot 33 <br />96+ feet on <br />Street A <br />Lot 34 <br />71 + feet on <br />Street A <br />Lot 35 <br />48+ feet on <br />Street A <br />(b) EC 9.6500 through EC 9.6505 Public Improvement Standards. <br />Page 46 of 63 <br />EC 9.6500 Easements. <br />(11) The city may require the dedication of easements for wastewater sewers and other public <br />utilities, and for access thereto for maintenance, of a sufficient width to meet the intended use, <br />provided the city makes findings to demonstrate consistency with constitutional requirements. <br />See Site Plan for location of proposed utility easements. <br />(2) Easements may be required along lot or parcel rear lines or side lines, or elsewhere as <br />necessary to provide needed facilities for present or future development of the area. <br />See Site Plan for location of proposed utility easements. <br />(3) No building, structure, tree, or other obstruction shall be placed or located on or in a public utility <br />easement. Prior to approval of a final PUD, final site review plans, or final plats, there shall <br />appear thereon a restriction showing compliance with this subsection. <br />Acknowledged and agreed. <br />EC 9.6505 Improvements - Specifications. All public improvements shall be designed and <br />constructed in accordance with adopted plans and policies, the procedures specified in Chapter 7 <br />of this code, and standards and specifications adopted pursuant to Chapter 7 of this <br />code. Additionally, all developments shall make and be served by the following infrastructure <br />improvements: <br />(1) Water Supply. All developments shall be served by the water system of the Eugene Water & <br />Electric Board. <br />See Sheet Cl: Wastewater and Water Plan. <br />(2) Sewage. All developments shall be served by the wastewater sewage system of the city, <br />complying with provisions in Chapter 6 of this code. Public improvements will be constructed <br />privately. <br />See Sheet Cl: Wastewater and Water Plan. <br />(3) Streets and Alleys. <br />(a)The developer shall grade and pave all streets and alleys in the development site. All paving <br />shall be to the width specified in EC 9.6870 Street Width and provide for drainage of all such <br />streets and alleys . <br />There is one street proposed as a private drive and is currently called Street A. It is paved to <br />21' wide, but it is not considered a public improvement. <br />(b) The developer shall pave streets and alleys adjacent to the development site to the width <br />specified in EC 9.6870 Street Width, unless such streets and alleys are already paved to that <br />width, provided the City makes findings to demonstrate consistency with constitutional <br />requirements. <br />Capital Drive is adjacent to the development site. It is considered a low volume local street. <br />Table 9.6870 requires a 45'- 55' right of way with 20'- 28' of paving. The right of way is <br />already dedicated at 50'. The existing street is undersized, narrowing to just 14 feet in some <br />places. There are currently no sidewalks.
