December 3-4, 2015 - LCDC Salem <br />Agenda Item 4, Attachment A <br />Proposed New Rules to Implement ORS 197A Public Draft 3 - November 23, 2015 <br />1 (i) Districts with a maximum density less than or equal to eight dwelling units per <br />2 acre: low density residential. A city may classify a district as low density residential <br />3 despite a maximum density of greater than eight dwelling units per acre if the <br />4 majority of existing residences within the district are single-family detached and if <br />5 the city has a high density residential district as determined by subparagraph (ii); <br />6 (ii) Districts with a maximum density greater than eight dwelling units per acre: <br />7 medium density residential. <br />8 (B) For cities with UGB populations greater than or equal to 2,500, districts shall be <br />9 classified as follows: <br />10 (i) Districts with a maximum density less than or equal to eight dwelling units per <br />11 acre: low density residential. A city may classify a district as low density residential <br />12 despite a maximum density of greater than eight dwelling units per acre if the <br />13 majority of existing residences within the district are single-family detached and the <br />14 city has a medium density residential district as determined by subparagraph (ii); <br />15 <br />(ii) Districts with a maximum density greater than eight dwelling units per acre and <br />16 <br />less than or equal to 16 dwelling units per acre: medium density residential, unless the <br />17 <br />district has been classified as low density residential pursuant to subparagraph (i). A <br />18 <br />city may classify a district as medium density residential despite a maximum density <br />19 <br />of greater than 16 dwelling units per acre if the majority of development within the <br />20 <br />district is developed at densities of between eight and 16 dwelling units per net acre <br />21 <br />and the city has a high density residential district as determined by subparagraph (iii); <br />22 (iii) Districts with a maximum density greater than 16 dwelling units per acre: high <br />23 density residential, unless the district has been classified as medium density <br />24 residential pursuant to subparagraph (ii); <br />25 (iv) A city may not classify as low density a district that allows higher residential <br />26 densities than a district the city has classified as medium density. A city may not <br />27 classify as medium density a district that allows higher residential densities than a <br />28 district the city has classified as high density. <br />29 (2) The city must identify all vacant lots and parcels with a residential comprehensive plan <br />30 designation.
