December 3-4, 2015 - LCDC Salem <br />Agenda Item 4, Attachment A <br />Proposed New Rules to Implement ORS 197A Public Draft 3 - November 23, 2015 <br />1 (a) For lots and parcels at least one-half acre in size that contain a single-family residence, <br />2 the city must subtract one-quarter acre for the residence, and count the remainder of the lot or <br />3 parcel as vacant land, and <br />4 (b) For lots and parcels at least one-half acre in size that contain more than one single-family <br />5 residence, multiple-family residences, non-residential uses, or ancillary uses such as parking <br />6 areas and recreational facilities, the city must identify vacant areas using an orthophoto or <br />7 other map of comparable geometric accuracy. For the purposes of this identification, all <br />8 publicly owned park land shall be considered developed. If the vacant area is at least one- <br />9 quarter acre, the city shall consider that portion of the lot or parcel to be vacant land. <br />10 (4) The city must determine the amount and mapped location of low density, medium density, <br />11 and high density vacant and partially vacant land in residential plan or zone districts within the <br />12 city's UGB. <br />13 (5) The city must: <br />14 (a) Identify all lots and parcels within a residential district that are developed; <br />15 (b) Identify all portions of partially vacant parcels within a residential district that are <br />16 developed with residential uses; <br />17 (c) Calculate the total area of land identified in (a) and (b); <br />18 (d) Calculate the total number of existing dwelling units located on the land identified in (a) <br />19 and (b); and <br />20 (e) Calculate the net density of residential development on the land identified in (a) and (b). <br />21 OAR 660-038-0070 <br />22 Adjust Residential Lands Inventory to Account for Constrained Lands <br />23 A city must adjust the inventory of residential lands prepared under OAR 660-038-0060 to <br />24 account for constrained lands using this rule. <br />25 (1) The city must identify the following physical constraints on land inventoried as vacant or <br />26 partially vacant under OAR 660-038-0060: <br />27 (a) Floodways and water bodies.
