Eugene Code -DRAFT- Application Requirements and Criteria <br />Planned Unit Development, Tentative Plan <br />9.6400 Purpose of Planned Unit Development. The Planned Unit Development (PUD) <br />provisions are designed to provide a high degree of flexibility in the design of the site <br />and the mix of land uses. The PUD process in intended to achieve the objectives <br />listed below. <br />(A) To create a sustainable environment that includes: <br />1. Shared use of services and facilities. <br />2. A compatible mix of land uses that encourage alternatives to the use of the <br />automobile. <br />3. A variety of dwelling types that help meet the needs of all income groups <br />in the community. <br />4. Preservation of existing natural resources and the opportunity to enhance <br />habitat areas. <br />5. Clustering of residential dwellings to achieve energy and resource <br />conservation while also achieving the planned density for the site. <br />(B) To create comprehensive site plans for geographic areas of sufficient size to <br />provide developments at least equal in quality to those that are achieved through <br />the traditional lot by lot development and that are reasonably compatible with <br />the surrounding area. <br />9.6405 Applicability <br />(A) Planned Unit Development provisions shall be used when any of the following <br />conditions exist: <br />1. The proposed development is subject to review and approval through the <br />PUD process according to an adopted refinement plan. <br />2. The property is zoned with a /PD zoning overlay. <br />3. One or more land uses proposed for the site are subject to review and <br />approval through the PUD process according to the zoning. <br />(B) In addition to the conditions listed in subsection (A) above, the PUD provisions <br />may be used at the request of the property owner when strict compliance with <br />the provisions in this Land Use Code would not provide an allowance for the <br />type of design being proposed. <br />9.6410 Tentative Planned Unit Development General Requirements. <br />(A) Ownership <br />The area included in a proposed Planned Unit Development shall either be <br />under single ownership or under the development control of a joint application <br />of owners or option holders. The area shall include all contiguous property <br />under the same ownership or development control as the applicant. Parcels <br />separated by a public right-of-way which would otherwise be contiguous, shall <br />be included in the PUD application unless the public right-of-way is designated <br />an arterial or collector on the Street Classification Map. <br />(B) Concurrent Review <br />Refer to EC regarding the ability to submit land use applications <br />concurrent with the review of a Tentative PUD. <br />0000787-5 <br />DRAFT 9.6-22 5/4/99 <br />I-7 <br />
