Commentary <br />Planned Unit Development <br />9.6400 Purpose of Planned Unit Development: <br />Based on existing EC 9.508 Purpose. Draft changed to clarify that PUD process is designed to <br />provide a high degree of flexibility to achieve resource protection, mix of uses, shared use of <br />facilities and other objectives. <br />9.6405 Applicability. <br />f Based on existing EC 9.509 Applicaby. Draft code deletes existing reference to uses which <br />were approved prior to the adoption of PUD provisions in 1968, but not yet developed. This <br />statement no longer appears necessary. Draft code clarifies that property owner may choose to <br />have proposed development reviewed through the PUD process even if the property is not <br />specifically zoned with the /PD overlay or required to go through the PUD process due to a <br />refinement plan policy. <br />9.6410 Tentative Planned Unit Development General Requirements. <br />(A) Ownership <br />Based on existing EC 9.510(1) Ownership. This section is modified to require that PUD's <br />include all contiguous property under the same ownership consistent with partition and <br />subdivision applications. Also provides clarification regarding "contiguous" parcels to allow <br />parcels separated by a public right-of-way to be included in the same PUD application. <br />(B) Concurrent Review <br />New section to refer code user to code section that provides a list of applications that can be <br />processed at the same time. <br />00007874 <br />514199 Commentary Page 9.6-22 <br />I-6 <br />
