5 <br />On September 17, 2013, City of Eugene public works staff submitted <br />referral comments with regard to the proposed PUD. Public works staff had <br />"no concerns related to traffic safety issues or poor service levels which will <br />result for this development." LUBA Rec., 1265. ER 143. Public works staff <br />recommended conditions requiring a half-street dedication along a portion of <br />the northern property boundary, and a 13-foot dedication east of the site <br />entrance. LUBA Rec. 1256. ER 134. Having determined that Oakleigh Lane <br />"provides safe passage for two-way vehicular traffic, bicycles, pedestrians and <br />emergency vehicles," it recommended deferred improvement of the dedicated <br />right-of-way via an irrevocable petition. LUBA Rec. 1268-69. ER 146-47. <br />On September 25, 2013, City staff issued a staff report recommending <br />approval of the. proposed PUD with conditions. LUBA Rec. 988-1026. On <br />October 2, 2013, the Hearings Official held a public hearing on both <br />applications. LUBA Rec. 986. He approved the PUD application on November <br />12, 2013. LUBA Rec. 347-411. ER 58-122. <br />On November 22, 2013, an adjoining landowner, Bryn Thorns appealed <br />the approval of the PUD application. LUBA Rec.. 319. The Planning <br />Commission. heard oral arguments on December 5, 201.3, and denied the appeal <br />on December 17, 2013. LUBA Rec. 228; 6-17. ER 43-54.
