OAKLEIGH <br />~~avaPe <br />gr~ 1 E, A'D0W <br />s. ; 'o a°e s A'a o a C O 1.1 O 4 S 3 A C <br />METRO PLAN - SPECIFIC ELEMENTS: (D) WILLAMETTE RIVER GREENWAY, RIVER CORRIDORS, <br />AND WATERWAYS ELEMENT <br />(Objective 1) Encourage use of river and waterway corridors to fulfill open <br />space, recreation, and resource protection needs. <br />Findings: The Goal 5 Riparian rule (OAR 660-23-090) separates the <br />identification of significance of the riparian resource from the process of <br />determining the appropriate protection forthat identified resource. A <br />jurisdiction may apply the `standard' or 'safe harbor' approaches as options <br />to all or select phases of the compliance process. For sites where <br />information is adequate, local governments shall make a determination of <br />whether the site is significant. The determination needs to be based on: a) <br />the quality, quantity, and location information; b) supplemental or <br />superseding significance criteria set out in the Goal 5 Administrative Rules; <br />and c) any additional criteria adopted by the local government, provided that <br />the criteria do not conflict with Goal 5 Administrative Rule requirements. <br />The 'Safe Harbor' approach for determining if a site is a significant natural <br />resource specifies that such a resource shall be defined by a boundary <br />extending 75 feet from the top of the river bank. The West.bank of the <br />Willamette River lies approximately 260-270 feet from the East property line <br />of the development site. As such, the site is not categorized as a significant <br />natural resource and does not conflict with the Metro Plan. <br />Oakleigh Meadow LLC is protecting the site by controlling the removal of <br />riparian non-native vegetation. A formal agreement between the owners <br />and the City of Eugene has been forged that will give responsibility to <br />Oakleigh Meadow LLC for the continued maintenance of the city-owned <br />public property. <br />(Objective 3) Encourage, where appropriate and in keeping with Green way <br />goals, development that respects the quality of rivers and waterways and <br />provides a variety of opportunities for enjoyment of those resources by the <br />public. <br />Findings: Currently, the subject site and the city-owned property to the East <br />do not provide access to the adjacent park and path system. The city-owned <br />parcel is underutilized as recreational open space due to its lack of access <br />and limited maintenance. The city-owned property also has some security <br />issues inherent with its present condition, such as visual connectivity. The <br />proposed cohousing development will correct this situation by means of <br />providing an ADA-compliant pedestrian and bicycle circulation system, site <br />building orientation that better defines the recreational space, and <br />Willamette Greenway -June 14, 2013 Page 8 of 20 Oakleigh Cohousing WG 13-0001 <br />1343 <br />
