<br />MEMORANDUM <br />Date:July9,2018 <br />To:FredWilson,EugeneHearingsOfficial <br />From:RodneyBohner,AssistantPlanner <br />Subject:LombardApartments(WG183/SR183/ARA188) <br />TheprimarypurposeofthismemoistoprovideaCityresponsetospecifictestimonyand <br />evidencesubmittedduringthefirstopenrecordperiod. <br />BACKGROUND <br />OnApril6,2018,theapplicantsubmittedtoCitystaffapplicationsforapprovalofaWillamette <br />unitsofmultifamilyhousing. <br />GreenwayPermit,SiteReview,andAdjustmentReviewsfor94 <br />Theconcurrentapplicationsweresubmittedforreviewunderthe/źƷǤ͸ƭneededhousing <br />approvalcriteria,anoptionthat(inaccordancewithStatelaw)anapplicantmaychooseatthe <br />timeofsubmittal.OnJune20,2018,staffprovidedtothepublicandtotheHearingsOfficial <br />findingsconcerningtheapplicationscompliancewithapplicableapprovalcriteria,and <br />ultimatelyrecommendingconditionalapproval. <br />The/źƷǤ͸ƭroleinreviewingtheWillametteGreenway/SiteReview/Adjustmentapplicationsisto <br />determineiftheapplicanthasmettheapplicableapprovalcriteria.Sometimes,issuesare <br />raisedwhichareoutsidethescopeoftheapprovalcriteria.Whiletheissuesmaybe <br />understandable,theauthoritytoactontheseissuesrestswithinwiththeapprovalcriteriafora <br />particularlanduseapplication.Putsimply,iftheapprovalcriteriadonotrequireanissuebe <br />addressed,itisnotsomethingthatthestaffreportcouldhavereachedto. <br />REVIEWOFNODALDEVELOPMENT(/ND)OVERLAYSETBACKREQUIREMENTS <br />Uponfurtherreviewsincethepublichearing,staffidentifiedthattheproposeddevelopment <br />doesnotappeartomeettheNodalDevelopmentsetbackrequirementsasrequiredbyEC <br />9.4290DensityandDevelopmentStandards: <br />EC9.4290DensityandDevelopmentStandards <br />(2)BuildingSetbacks <br /> <br />
