(a)Buildingsshallbesetbackamaximumof15feetfromthestreet.Thereisno <br />minimumsetback. <br />The/NDoverlayprovidesamaximumbuildingsetbackof15feetfromstreets,andstatesthat <br />requiredtomeetthe <br />inthecaseasiteisadjacenttomorethanonestreet,abuildingis <br />maximumononlyoneofthestreets.Theapplicantstatesthatcompliancewiththestandards <br />aboveisprovidedonsheetA1ofitssiteplanmaterials. <br />OnJune22,2018,theapplicantsubmittedaresponsetothestaffreportrecommended <br />addressesEC9.5500(4)(b)Minimum <br />conditionsofapproval.Specifically,theğƦƦƌźĭğƓƷƭmemo <br />andMaximumBuildingSetbacks.Inthiscase,theadjustmentrespondstobuildingsetbacksas <br />specifiedbymultiplefamilydevelopmentstandards(EC9.5500(4)(b)),andstaffsupportedthe <br />adjustment.However,staffmissedtheopportunitytoaddressmaximumbuildingsetbacksas <br />setforthinthe/NDstandards.Inthecaseofaconflictbetween/NDstandardsandthoseof <br />applicablebasezoneprovisions,themorerestrictivecontrols.Staffendeavorstoprovidethe <br />applicanttheopportunitytoaddressEC9.4290(2).Assuch,thefollowingconditionofapproval <br />isrecommended. <br />Priortoissuanceofadevelopmentpermit,theapplicantshallrevisethesiteplansto <br />showcompliancewithEC9.4290(2);orshallreceiveapprovalofanadjustmenttothis <br />standard. <br />Withthisconditionofapproval,staffbelievesthattheapplicablerequirementsofthe/ND <br />overlaycanbemet. <br />REVIEWOFKEYISSUESRAISED <br />ThepublichearingforthesubjectapprovalswasheldonJune27,2018.Duringtestimonyin <br />oppositiontothesubjectapplications,theHearingsOfficialreceivedanumberofwritten <br />statementswhichhavebeenincludedintherecordforthesubjectapplication.Thetestimony <br />doesnotpresentclearissuestatementsinallcases,however,staffhasattemptedtocategorize <br />selectedkeyissueswhicharebrieflyaddressedbelow: <br />1.WillametteGreenwayPermitApplicability <br />StaffanticipatesthatawrittenresponsewillbeprovidedbytheCity!ƷƷƚƩƓĻǤƭOfficeinregards <br />totheapplicabilityoftheWillametteGreenwayPermitrequirementstotheproposed <br />development,forthcomingduringthesecond(responsive)openrecordperiodandnolaterthan <br />July16,2018at5p.m. <br />2.WillametteGreenwayPermitConformity <br />Basedonthestatementsoftheapplicant,andavailableevidence,staffbelievetheapplicant <br />meetsWillametteGreenwayPermitapprovalcriteriaasprovidedinthefindingsincludedinthe <br />June20,2018StaffReport. <br /> <br />
