A.-Ok <br />WPIanning <br />Findings and Decision of the Eugene Planning Director <br />Vacation of an Unimproved Public Utility Easement Approval For: <br />CHELDER (VEU 22-3) <br />Submitted: March 31, 2022 <br />Deemed Complete: May 3, 2022 <br />Location: 3431/3433 Baywood Street <br />Tax Lot: 04300 of Assessor's Map: 17-04-01-34 <br />Zoning: R-1 Low -Density Residential <br />Request: Vacate a portion of unimproved public utility easement <br />Applicant / Representative: Andrew Hardman & Carrie Hardman <br />Lead City Staff: Nicholas Gioello, Associate Planner, (541) 682-5453 <br />Related Permits/Applications: n/a <br />EVALULATION: <br />Based on the information provided by the applicant, the City has determined that this request complies with <br />Eugene Code (EC) Section 9.8705 Applicability of Vacation Procedures and EC 9.8710 Vacations, Application <br />Requirements. As such, it is subject to review and approval in accordance with the requirements and <br />application criteria of EC 9.8715 and with the Type I land use application procedures beginning at EC 9.7100. <br />The applicable approval criteria are presented below in bold typeface with findings and conclusions following <br />each. <br />EC 9.8715 (1) The subject area is not presently or in the future needed for public services, facilities, or <br />utilities, and the vacation does not prevent the extension of, or the retention of public <br />services, facilities, or utilities; or if needed, the applicant shall provide for the replacement and <br />abandonment of any existing public services, facilities or utilities in the subject area. <br />Complies <br />Findings: <br />The applicant is proposing to vacate the northern 70 -foot portion of a 7 -foot wide <br />®YES <br />❑ NO <br />unimproved public utility easement along the east boundary of the property. The <br />southern 25 -foot portion of the easment will remain as an EWEB overhead power line <br />crosses this area. <br />City of Eugene Public Works staff confirm that the unimproved public utility easement <br />proposed to be vacated is not needed now or in the future for public services, facilities, <br />or utilities, and that approval of the request will not limit access or hinder the extension <br />of needed public services, facilities or utilities.
