This application requests a <br />zone change for the subject taxlot from AG, Agricultural to R1, Low Density Residential. This <br />application is submitted pursuant to EC 9.8865. <br />SURROUNDING PROPERTY <br />The property is located on 4199 Scenic Drive and is surrounded by a mix of R1 and AG zoned <br />properties both unannexed and annexed which are developed with primarily single family <br />dwellings. <br />ZONE CHANGE APPLICABLE CODE CRITERIA <br />(1) The proposed change is consistent with applicable provisions of the Metro Plan. <br />The written text of the Metro Plan shall take precedence over the metro plan diagram <br />where apparent conflicts or inconsistencies exist. <br />Response: The subject property is designated for low density residential use on the Metro Plan. <br />(2) The proposed zone change is consistent with applicable adopted refinement <br />plans. In the event of inconsistencies between these plans and the Metro Plan, The <br />Metro Plan controls. <br />Response: The applicable adopted policy for the subject property is the River Road-Santa Clara urban <br />facilities plan for the requested zone change. The applicable land use diagram designates the subject <br />property for low density residential use, which is consistent with the proposed R-1 zoning. No indication <br />of Planned Unit Development overlay is apparent for the subject property. <br />THE RIVER ROAD - SANTA CLARA URBAN FACILITIES PLAN: <br />Unincorporated Subarea Policies and Proposed Actions: <br />2. The City shall require future developments on parcels abutting the UGB to provide and effective <br />transition between urban and rural land uses.
