Approval Criteria – Supporting Facts and Finding <br /> <br />This section is organized by documenting the applicable application procedures and approval criteria per <br />EC 9.8825 in bold italics, followed by proposed findings in normal text. <br /> <br />9.8825 Modifications to a Willamette River Greenway Permit. <br />After the effective date of Willamette River Greenway Permit approval, modifications of the <br />Willamette River Greenway Permit, as provided in EC 9.7230 and EC 9.7340, may be <br />considered in accordance with the Type II Application Procedures contained <br />in EC 9.7200 through EC 9.7230. The planning director shall decide whether to grant the <br />requested modification based on the following criteria: <br /> <br />Overview: In coordination with City staff, it was determined that the proposed development is defined as <br />an “intensification” of the existing development as approved in the 2019 WG permit. Per EC 9.0500, the <br />City’s codified definitions describe an intensification of a use as “[a]ny additions that increase or expand <br />the area or amount of an existing use, or the level of activity.” The proposed athletic court expands the <br />area dedicated to the existing ECCO school use and the courts increase the level of activity by <br />introducing an outdoor recreational activity that does not currently exist on the site. Therefore, the <br />proposed addition of an athletic court requires a Modification to the approved 2019 WG permit. <br /> <br />(1) The modification will be consistent with the conditions of the original approval; and <br /> <br />Findings: The proposed Modification is consistent with the conditions of the original approval (City File <br />No. WG 19-2), which are excerpted below from the Hearings Official’s decision. <br /> <br />1. The applicant shall add a note to the site plan (Sheet C1.0) that states: “Final landscaping <br />consistent with the Landscape Plan shall be installed before final occupancy.” <br />2. The applicant shall add a note to the site plan (Sheet C1.0) that states: “Bicycle parking <br />shown is conceptual and the required location, number and specific design will be reviewed <br />during the building permit process to ensure compliance with EC 9.6105.” <br />3. The applicant shall add a note to the site plan (Sheet C1.0) that states: “Accessible parking is <br />conceptual. The location, number and specific dimensions will be reviewed during the building <br />permit process to ensure compliance with EC 9.6410.” <br />4. The applicant shall add a note to the site plan (Sheet C1.0) that states: “Pedestrian circulation <br />shown is conceptual and the location and specific design will be reviewed during the building <br />permit process to ensure compliance with EC 9.6730.” <br /> <br />
