<br />Metro Planning, Inc July 2026 Kendall & James Homes LLC <br />3 <br /> <br />(5) The written statement submitted with the subdivision application shall clearly state whether the applicant believes that <br />the proposal qualifies for the expedited land division procedures in EC9.7900 through EC 9.7925, and whether the applicant is <br />electing to use the expedited land division procedures in EC 9.7900 through EC 9.7925. <br /> <br />Response: The applicant is not electing to use the expedited land division procedures. The applicant is electing to use the <br />‘General/Discretionary’ approval criteria contained in EC 9.8515 and this written narrative addresses the proposal’s compliance with <br />applicable criteria outlined therein. <br /> <br /> <br /> <br />EC 9.8515 Subdivision, Tentative Plan Approval Criteria – General <br /> <br />The planning director shall approve, approve with conditions, or deny a proposed subdivision. Approval, or approval with <br />conditions shall be based on compliance with the following criteria: <br /> <br />(1) The proposed subdivision complies with all of the following, unless specifically exempt from compliance through <br />a code provision applicable to a special area zone or overlay zone: <br /> <br />(a) EC 9.2000 through 9.4170 regarding lot dimensions and density requirements for the subject zone and <br />overlay zone. Within the /WR Water Resources Conservation Overlay Zone, no new lot may be created if <br />more than 33% of the lot, as created , would occupy either: <br /> <br />1. The combined area of the /WR conservation setback and any portion of the Goal 5 Water Resource <br />Site that extends landward beyond the conservation setback; or <br /> <br /> 2. The /WQ Management Area. <br /> <br />The subject property is zoned R-1 with no applicable Special Areas or Overlay Zones, including the /WR Water Resources <br />Conservation and /WQ Water Quality overlay zones. Section (1)(a) above is not applicable. <br /> <br />The subject property is surrounded by R-1 zoned properties on all sides. The applicable R-1 zone criteria contained in EC 9.2750 and <br />EC 9.2760, as well as applicable subsections, are summarily addressed below. <br /> <br /> <br /> <br />EC 9.2750 Residential Zone Development Standards <br /> <br /> Density <br /> <br /> Per EC 9.2750, there is no minimum density requirement in R-1; maximum density is 14 dwelling units per acre. <br />The subject property is ~61,855 square feet (~1.42 acres) making the maximum density for the entire subject parcel <br />approximately 20 dwelling units. With nine proposed lots the subject property can easily meet density requirements at the time <br />of future development. <br /> <br /> Building Height <br /> <br />The existing dwelling and garage are proposed to be removed prior to final plat. Future dwellings will comply with building <br />height standards at time of building permit process. <br /> <br /> <br /> Building Setbacks <br /> <br />The existing dwelling and garage are proposed to be removed prior to final plat. All future dwellings will comply with setback <br />standards of 5 feet from all new property lines and 10 feet between buildings . <br />
