Slocum Orthopedics Page 4 of 9 <br />Standards Review – Written Statement <br />July 2,2026 <br /> <br /> <br /> <br /> <br />The Satre Group • 375 West 4th Avenue, Suite 201, Eugene, OR 97401 • (541) 686-4540 • www.satregroup.com <br /> <br />(4) The site plan and application shall be signed by each of the professionals preparing the application, <br />certifying that the application is true and correct to the best of his or her professional ability, and that, if <br />applicable, the professional standards of his or her profession have been met therein. <br /> <br />Finding: The site plan and application materials have been signed by the professionals responsible for <br />their preparation. Accordingly, the application complies with the requirements of EC 9.8475(4), and this <br />criterion is met. <br /> <br />9.4778 /WQ Water Quality Overlay Zone – WQ Management Area. <br />(1) Except as provided in subsections (2), (3) or (4) the /WQ Management Area is that area depicted on the <br />city’s adopted Water Quality Waterways Map, including any amendments made to it. <br />(b) For a waterway identified on the Water Quality Waterways Map as a waterway identified pursuant to <br />section 303(d) of the federal Clean Water Act, or a tributary to such a waterway, the applicable <br />setback is 25 feet from top of high bank (THB). For purposes of EC 9.4770 through 9.4790 and <br />9.8030(25), THB is the highest point at which the vertical rise of the waterway bank meets the <br />horizontal grade of the adjoining topography. <br /> <br />Finding: The stormwater conveyance channel located on the subject property is identified on the Water <br />Quality Waterways Map as a tributary to a waterway listed pursuant to Section 303(d) of the Federal Clean <br />Water Act. Therefore, pursuant to EC 9.4775(b), the applicable setback is 25 feet from the top of high <br />bank (THB), defined as the highest point at which the vertical rise of the waterway bank meets the <br />horizontal grade of the adjoining topography. <br /> <br />As shown on the submitted site plans, a portion of the proposed stormwater pipe conveyance, storm pipe <br />end section and rock energy dissipation outfall, will be located within the 25-foot setback area, and <br />associated storm conveyance improvements will require temporary trenching excavation within the <br />setback and bank area, but not within the channel. These activities are subject to Standards Review under <br />the applicable provisions of EC 9.4780. The extent of the proposed impacts and the measures <br />implemented to avoid, minimize, and restore disturbance within the setback area are described in these <br />findings. Accordingly, the proposal has been evaluated based on the applicable 25-foot setback standard. <br /> <br />(3) As part of the city’s consideration of an application for a development permit or land use approval, the city <br />shall exclude from the /WQ Management Area: <br />Fences and landscaping do not cause an area to be “developed” to warrant exclusion from the /WQ <br />Management Area. All other uses and structures that were legally established prior to June 10, 2009 but <br />that do not comply with the allowed uses and standards of the /WQ Overlay Zone are subject to EC <br />9.1200 through EC 9.1240 Legal Nonconforming Situations; <br /> <br />Finding: The existing chain-link fence is located along the 25-foot THB setback and does not constitute <br />development that would warrant exclusion from the WQ Management Area. The development project <br />landscape plans included irrigation equipment within the setback; however, the applicant is removing the <br />equipment from the setback and relocating it to a parking island outside the WQ Management Area as part <br />of the building permit. No other structures or legally nonconforming uses are present within the setback. <br />Therefore, the proposal is consistent with the applicable standards. <br /> <br />9.4780 /WQ Water Quality Overlay Zone – Permitted and Prohibited Uses. Uses are permitted or <br />prohibited within the /WQ Water Quality Overlay Zone based on whether they occur outside or within the /WQ <br />Management Area as follows: <br />(1) Uses Permitted Outside /WQ Management Area. <br />(a) The uses permitted on portions of a lot located outside of the /WQ Management Area are the same as <br />those otherwise permitted on that lot without consideration of the /WQ Water Quality Overlay Zone; <br />and <br />(b) Prior to issuance of a development permit, the city shall verify that the /WQ Management Area setback <br />has been accurately demarcated by a prominent and continuous protective feature indicating a “No
