Slocum Orthopedics Page 5 of 9 <br />Standards Review – Written Statement <br />July 2,2026 <br /> <br /> <br /> <br /> <br />The Satre Group • 375 West 4th Avenue, Suite 201, Eugene, OR 97401 • (541) 686-4540 • www.satregroup.com <br /> <br />Disturbance Area.” No site preparation, including but not limited to vegetation removal, may take place <br />within 50 feet of the /WQ Management Area, until such verification has been provided. <br /> <br />Finding: Prior to the issuance of any development permit, the /WQ Management Area setback will be <br />accurately demarcated in the field by a prominent and continuous protective feature identifying the area as <br />a "No Disturbance Area," as required by this criterion. The applicant has acknowledged the applicability of <br />the Standards Review process and has established protective demarcation of the Water Quality <br />Management Area. No site preparation activities, including vegetation removal or other disturbance, are <br />being conducted within the Water Quality Management Area or within 50 feet thereof pending completion <br />of the Standards Review process and verification by the City. Compliance with this requirement will be <br />maintained prior to issuance of any development permit. Therefore, this criterion is met. <br /> <br />(2) Uses Permitted Within /WQ Management Areas. Subject to any applicable development permits, the <br />following uses are the only uses permitted outright within the /WQ Management Area: <br />(a) Vegetation Planting and Management. <br />(b) Removal of Plants and Vegetation. <br />(c) Maintenance, Repair and Reconstruction Activities. <br />(d) Emergency Activities. <br />(e) Construction and Maintenance of Vegetated Stormwater Management Facilities. Swales, filter strips, <br />constructed wetlands, and other vegetated stormwater management facilities for stormwater quality or flow <br />control are permitted if otherwise approved through the provisions of EC 9.6791 through 9.6797 in <br />accordance with the Stormwater Management Manual adopted by administrative order of the city <br />manager; <br /> <br />Finding: Pursuant to EC 9.4780(2)(e), vegetated stormwater management facilities, including swales, filter <br />strips, constructed wetlands, and other stormwater quality and flow control facilities, are permitted within <br />the Water Quality Management Area when approved in accordance with EC 9.6791 through 9.6797 and <br />the City of Eugene Stormwater Management Manual. The proposed development consists of a medical <br />facility located outside the Water Quality Management Area. The project's stormwater management <br />system has been designed in accordance with applicable City stormwater standards, with the majority of <br />stormwater treatment and detention facilities located outside the Water Quality Management Area. <br />Stormwater is conveyed via an underground piped system to a flow-control facility located within the bank <br />area of the stormwater conveyance channel. As a vegetated stormwater management facility, this use is <br />expressly permitted under EC 9.4780(2)(e). The need for this Standards Review arises not from the <br />stormwater facility itself and the associated outfall, but from the temporary disturbance of vegetation and <br />associated restoration activities within the Water Quality Management Area required to construct the <br />facility and conveyance improvements. Therefore, the proposed use is permitted under EC 9.4780(2)(e), <br />and this criterion is met. <br /> <br />(3) Uses Subject to Standards Review Within the /WQ Management Area. Unless prohibited by subsection <br />(4), or permitted outright in subsection (2), the following uses are permitted, subject to the standards <br />review process beginning with EC 9.8460. Consistency with the specific standards provided or referenced <br />for each use below shall be used as the criteria for approval. These uses may require additional <br />development permits pursuant to other provisions of this code. <br />(a) Construction of private water quality improvements, including stabilization or reconfiguration of <br />channels and pond banks to improve stability and installation of aeration features. Subject to EC <br />9.4790 /WQ Water Quality Overlay Zone Development Standards (1) through (3) and (7) through (11); <br /> <br />Finding: Pursuant to EC 9.4780(3)(a), the construction of private water quality improvements and similar <br />improvements, is permitted subject to Standards Review and compliance with the applicable development <br />standards of EC 9.4790(1) through (3) and (7) through (11). The proposed development includes <br />stormwater management improvements designed to collect, convey, and control stormwater runoff <br />generated by the medical facility development. While the primary stormwater facility is located outside the <br />Water Quality Management Area, portions of the associated conveyance and flow-control infrastructure
