THE SITE AND EXISTING CONDITIONS <br />A. Development Site. <br />The development site consists of a single tax lot, Map 17-03-16-43, Tax Lot 104, comprising <br />approximately 6.67 acres. The property is a flag lot located on the south side of Chad Drive in the <br />northeastern portion of Eugene. The site is zoned Campus Employment (E-1) and is partially subject <br />to the Water Quality (/WQ) Overlay District. <br /> <br />The property is bordered by Beltline <br />Highway to the south and by <br />properties zoned Campus <br />Employment (E-1) to the north, east, <br />and west. Existing development in the <br />surrounding area consists primarily of <br />employment and commercial uses <br />consistent with the E-1 zoning district. <br /> <br />The property owner has received <br />approval under Building Permit No. <br />25-05093-01 to construct a 41,815- <br />square-foot, single-story surgical <br />center on the site. In conjunction with <br />the proposed development, the <br />applicant previously obtained approval <br />of an Adjustment Review (ARA 25-19) <br />and a Traffic Impact Analysis (TIA 25- <br />02), both of which were processed <br />and approved as Type II applications. <br />The current application pertains to improvements associated with the approved development, <br />including stormwater infrastructure located within the Water Quality Management Area and its <br />associated setback. <br /> <br />III. STANDARDS REVIEW – APPROVAL CRITERIA AND FINDINGS <br />This section is presented in the same order of applicable requirements found in Eugene Code EC 9.8460- <br />9.8474, Standards Review, and EC 9.4770 – 9.4790 (/WQ Water Quality Overlay Zone). Applicable <br />sections of the Code are in italics, followed by proposed findings in normal text. <br /> <br />EC 9.8460-9.8474 – STANDARDS REVIEW <br />9.8460 Purpose of Standards Review. The standards review process is intended to provide a way to <br />effectively review specific types of proposed development with standards outlined in this land use <br />code. <br /> <br />Finding: The findings presented in this written statement demonstrate that the Standards Review Request <br />for the Boulder Associates Orthopedic Center complies with the stated purpose of Standards Review. <br />Therefore, with respect to Purpose Statement EC 9.8460, the criterion is met. <br /> <br />9.8465 Applicability. Where this land use code allows a specific use, subject to standards review, the <br />application for review shall be considered under a Type II process, unless the subject land use <br />application is being considered under a Type III application process. If the review requested is a <br />part of a Type III application, the review of standards shall be considered concurrently under a <br />Type III application process. No development permit shall be issued by the city prior to completion <br />of the standards review. <br /> <br />Finding: As documented in these findings, the proposed impacts within and protections afforded to the <br />Non-Goal 5 stormwater conveyance setback area are allowable uses subject to Standards Review and are
