The applicant shall relocate the existing wastewater service line serving Middle Housing Lot (Parcel) 2 outside the <br />bounds of Middle Housing Lot (Parcel) 1; or record a deed restriction to ensure that Middle Housing Lots (Parcels) <br />1 and 2 will remain under common ownership until the wastewater has been relocated and any necessary <br />easements have been established; or the applicant shall create a Private Utility Easement, which is subject to city <br />review and approval prior to recording the final plat, which will be cross referenced on the plat and be <br />accompanied by a maintenance agreement for the Utility Easement, which addresses the rights and <br />responsibilities of each parcel to the private utility easement area. <br />A private utility easement is shown on the Final Plat and the easement document is attached. <br /> <br />4. The applicant shall relocate the existing electric line serving Middle Housing Lot (Parcel) 2 outside the bounds of <br />Middle Housing Lot (Parcel) 1; or into the proposed Public Utility easement or EWEB utility easement; Or record a <br />deed restriction to ensure that Middle Housing Lots (Parcels) 1 and 2 will remain under common ownership until <br />the electric service has been relocated and any necessary easements have been established. <br />An EWEB Easement is being dedicated on the Final Plat for the EWEB electric line. The electric line is existing <br />and is underground. It will be within the bounds of the proposed EWEB Easement. <br /> <br />5. The applicant shall provide documentation from EWEB confirming that the proposed public utility easement meets <br />all applicable EWEB requirements. <br />As evidenced in EWEB comments in Attachment A, they require either a 5’ wide PUE or EWEB Easement over the <br />existing underground electric line. A 5’ wide EWEB is proposed and is dedicated on the Final Plat meeting EWEB’s <br />requirements. An EWEB Easement is attached. <br /> <br />6. The applicant must: provide evidence that the structure on Parcel 1 complies with ORSC with respect to its <br />proximity to the eastern property line; Or provide a copy of deed restriction holding the middle housing lots and <br />common ownership until such time as the structure on Parcel 1 complies with the ORSC. <br />See attached Deed Restriction holding the Middle Housing Lots in common ownership. <br /> <br />7. Prior to final plat, the applicant must: provide evidence that the existing shed has been demolished or relocated; or <br />record and provide a copy of a deed restriction holding the Middle Housing Lots in common ownership until such <br />time as the shed is demolished or relocated; or if retained, provide evidence that the structure otherwise complies <br />with ORSC. <br />See attached Deed Restriction holding the Middle Housing Lots in common ownership. <br /> <br />Post Approval <br /> <br />The applicant has requested review of this Middle Housing Land Division application subject to the amended <br />Expedited Land Division procedures of ORS 197.365, as amended by House Bill 2138. Pursuant to House Bill 2138, <br />the decision may only be appealed by the applicant. Appeals to Expedited Land Division determinations are subject to <br />the amended provisions of ORS 197.830 to 197.855, as amended by House Bill 2138. Appeals of Expedited Land <br />Division Decisions are subject to review by the Oregon Land Use Board of Appeals (LUBA). The decision of the <br />Planning Director Final on the local level. The Tentative Middle Housing Land Division Approval shall remain effective <br />for 36 months following the effective date of approval, in accordance with EC 9.7230. <br /> <br />A final site plan and performance agreement will be required for this Middle Housing Land Division in accordance with <br />EC 9.7025. EC 9.7925 states that, when the approval requires a final site plan, the applicant shall provide the city with <br />four copies of the plans that meet the conditions of approval of the Planning Director’s decision. <br /> <br />This approval does not relieve the applicant from complying with other applicable provisions of the Eugene Code, <br />Oregon Revised Statutes, or any other laws which may govern the development of the subject property <br /> <br />Attachments <br />Attachment A: Eugene Water and Electric Board Referral. <br /> <br /> <br /> <br />
