The construction <br />of homes or other structures is not included in this application. Architectural building <br />features and potential intrusions will be reviewed with the building permits for future <br />homes on the individual lots. <br />(10) Except as provided in this subsection (10), no interior setback along the side <br />property lines is required if the buildings abut or share a common wall that <br />conforms to adopted state building codes. A 5 foot setback is required at the <br />end of the rowhouse building, or a minimum of 10 feet between the rowhouse <br />building and any adjacent building. A 5 foot setback is also required along an <br />alley. <br />Response: Interior setbacks are not required for the townhouses where they share a common wall. <br />As illustrated on the Preliminary Plans (Exhibit A), the townhouses have a minimum 10- <br />foot setback between buildings and a 5-foot setback at the end of the townhouse <br />building. This standard is met where applicable. <br />(11) Alley Access Lots/Parcels. There are no front yard setbacks since there is no <br />frontage on a street. (See EC 9.2751(18) for Alley Access Lot Standards in R- <br />1.) <br />Response: The planned subdivision does not include any alley access lots. This standard is not <br />applicable. <br />(12) The 18 foot setback requirement for garages and carports is measured through <br />the centerline of the driveway from the front property line to either the garage <br />door or to the frontmost support post of a carport. <br />Response: This standard is understood. Compliance will be demonstrated with the building permits <br />for future homes on the individual lots. <br />(…) <br />(14) Fences. <br />(a) Types. The type of fence (including walls or screens) used is subject <br />to specific requirements stated in the landscape standards beginning <br />at EC 9.6200 Purpose of Landscape Standards. The standards apply <br />to walls, fences, and screens of all types including open, solid, wood, <br />metal, wire, masonry or other material. Use of barbed wire and <br />electric fencing is regulated in EC 6.010(d) Fences. <br />(b) Location and Heights. <br />1. Except as provided in subsection (c) below, fences up to 42 <br />inches in height are permitted within the required front yard <br />setback. For corner lots or double frontage lots, a fence <br />between 42 inches and 6 feet in height is permitted within <br />one of the two front yard setbacks, so long as for corner lots, <br />this fence cannot extend past a line created by an extension <br />of the front wall of the dwelling. (See Figure 9.2751(14)(b)1.) <br />2. Except as provided in subsection (c) below, fences up to 6 <br />feet in height are permitted within the required interior yard <br />setback. <br />3. The height of fences that are not located within the required <br />setback areas is the same as the regular height limits of the <br />zone.
