No new public street is proposed as part of this Middle Housing Land Division. <br />Because Dewey Street already contains 60 feet of public right-of-way, the <br />existing right-of-way meets the applicable local street right-of-way width <br />standard under EC 9.6870. Therefore, no additional right-of-way dedication is <br />proposed or understood to be required for this application based on street width. <br />The proposed rear middle housing lot will receive access, pedestrian access, and <br />utility service to Dewey Street through a 10.8-foot-wide access and utility <br />easement shown on the tentative plan. This private easement does not create a <br />new public street and does not alter the existing public street width. <br />Although Dewey Street lacks full urban frontage improvements along the subject <br />property frontage, the applicant requests that any required street frontage <br />improvements, including curb, gutter, sidewalk, street lights, street trees, or <br />related frontage improvements, be addressed through an irrevocable petition <br />for future public improvements, with construction deferred until City -triggered <br />public improvement process. This approach allows the Middle Housing Land <br />Division to proceed while preserving the City's ability to require or coordinate <br />future public improvements along Dewey Street. <br />This standard is satisfied. <br />EC 9.67S0 - Special Setback Standards <br />Criterion / Standard: <br />EC 9.6750 addresses special setback standards. Eugene's MHLD tentative plan <br />checklist requires the tentative plan to show any special setbacks in accordance <br />with EC 9.6750. <br />Response: <br />No special setback applies to the subject property based on the adjacent street <br />classification and existing/proposed right-of-way conditions. <br />IX.
