EC 9.8195 - Purpose of Middle Housing Land Division, Final Plat <br />Criterion / Standard: <br />EC 9.8195 explains that the MHLD process includes both tentative plan and final <br />plat procedures, and that EC 9.8195 through 9.8199 govern final plat applications <br />to ensure tentative approval conditions have been met. <br />Response: <br />This application is for tentative plan approval. Following tentative plan approval <br />and satisfaction of any conditions of approval, the applicant will submit a final <br />plat application in accordance with EC 9.8195 through EC 9.8199 and applicable <br />state and local platting requirements. This standard is acknowledged. <br />VI. Utility, Street, and Special Setback Standards <br />EC 9.6775 - Underground Utilities <br />Criterion / Standard: <br />EC 9.6775 identifies exemptions from underground utility requirements and <br />requires new on -site utilities to be placed underground if there is a utility -owned <br />structure immediately adjacent to the development site, unless an adjustment <br />applies. It also allows certain exceptions for facilities such as pad -mounted <br />transformers, switch cabinets, backflow prevention devices, and closures needed <br />to operate and maintain utility systems. <br />Response: <br />The tentative utility plan shows existing and proposed utilities serving the middle <br />housing lots. New on -site utilities will be placed underground where required by <br />EC 9.6775. Existing legally established overhead service will remain, and new <br />connections qualify for the exemption in EC 9.6775(1).
